What are the odds Paul Czajka, DA of Columbia will prosecute Nussinow for 35 counts of Animal Cruelty after being arrested for the second time by the New York State Troopers on 3/17/20 ? Nussinow was charged with 35 counts of “injuring, torturing, and starving” the animals, including 20 Thoroughbred horses, and 12 animals subsequently died, including a Thoroughbred broodmare.
7/4/2017: NYSP arrested NUSSINOW for 11 counts of animal cruelty for 8 emaciated horses and 32 horses without any water on a 90-degree day, including 7 Thoroughbred broodmares and 3 foals found in a hot barn without any water according to the police arrest record.
12/16/17: Paul Czajka, DA convened a Grand Jury to review the charges against Nussinow "supposedly" seeking an indictment.

The most important factor in the grand jury's probable cause determination is the evidence presented during the proceedings, and the prosecutor is the sole source of the evidence upon which the grand jury must decide whether to indict”.
After Nussinow’s case ended without any indictment, Paul Czajka, DA stated the Grand Jury did not “FIND” enough evidence to proceed.
55,670 Supporters of “STOP the Animal Neglect in Columbia County, N.Y.” would like to know whose fault it was Nussinow was not indicted if the District Attorney’s Office was responsible for “selecting” only 4 of 11 charges, and providing the “defense team” with their own mini version of a one-sided trial without any rebuttal by the prosecution experts to mislead the Grand Jurors ?
What percentage of cases do grand juries indict?
“The indictment rate is about 98–99%; the grand jury can broaden (about 1% of the time) or narrow (about 3% of the time) the counts in the indictment as well”. So how come Paul Czajka, DA failed to indict Nussinow, a New York Thoroughbred Breeder in 2017?
55,670 Supporters of “Stop the Animal Cruelty in Columbia County, N.Y” bet it was because the prosecution only presented 4 of the 11 animal cruelty charges, or only 36.36% of the charges, a far cry from the 3% deviation stated above. The prosecution withheld expert testimony, credible witnesses, and evidence for the prosecution which misled the Grand Jurors and appears they were “tricked” into voting no bill.
What are the chances the “botched Grand Jury” created a false arrest claim filed by Nussinow?
It appears to be a 1-1 favorite the “botched Grand Jury” directly caused the lawsuit filed by Nussinow for 15 million dollars against the County of Columbia, N.Y. (Paul Czajka, DA), Columbia Greene Humane Society (CGHS), the designated lead animal cruelty investigative agency, Ronald Perez, President of CGHS, and Lee DeLisle, Chief Animal Cruelty Investigator of CGHS, and all the associated legal expenses paid for by the taxpayers. Insurance Fraud against the Government is a serious felony.
How unlikely is it that in 2020-2021 Paul Czajka, DA of Columbia County, New York refused to convene a new Grand Jury to indict Nussinow, a New York Thoroughbred Breeder after being arrested for a second time on 3/17/20 for 35 counts of injuring, torturing, and starving the animals, including 20 Thoroughbred horses, with 12 dead animals despite 24 more charges of animal cruelty filed against Nussinow in 2020 versus 2017, and 12 known dead animals?
In our opinion, because Paul Czajka, DA did not convene a Grand Jury for the escalating alleged violence against the Thoroughbred horses, farm, and companion animals in 2020, charged against a New York Thoroughbred Breeder, is no surprise given the long painful history and mishandling of this case.
Nussinow was charged with 35 counts of animal cruelty by the NYSP on 3/17/20, after the Thoroughbred horses and other animals were evaluated by “unbiased” Veterinarians from the New York State Agriculture and Markets Department on 1/2/20 after probable cause of neglect, and seized by the police.
The number of criminal animal cruelty charges between 2017 to 2020 filed against Nussinow increased by 31%, and the number of animals killed increased by 100%, yet it appears Judge Jonathan Nichols and/or Paul Czajka, DA transferred the case against the New York Thoroughbred Breeder back to the Town of Clermont to face misdemeanor charges. Really?
What are the odds the defendant would have several more Thoroughbreds and other horses in her custody “prior” to the case being adjudicated from 2020 after being arrested for 35 counts of animal cruelty by the NYSP?
It appears to be 1-1 favorite given the apparent gross mishandling of this case, including Nussinow being in contempt of court 2017 during a seize in place court order. In 2017, during a court “seize in place” order, NUSSINOW purchased 4 more Thoroughbreds from the Saratoga Fasig Tipton Fall Thoroughbred Sale for $ 6,900 and brought them to Blue Star Thoroughbred Breeding Farm in contempt of court. Nussinow was not additionally charged or re-arrested for contempt of court by the District Attorney’s Office, or Ron Perez and Lee DeLisle, both Peace Officers employed by CGHS. CGHS (Perez and DeLisle) were responsible for oversight of the “seized farm” and the proper care of the animals with 24/7 unannounced access until the case was adjudicated.
Sadly, the same 4 Thoroughbred broodmares in foal Nussinow purchased in contempt of court 10/2017, were clinging to life on 1/2/20 when the New York State Troopers, assisted by Veterinarians from the State seized the neglected animals from Nussinow. All 38 animals were brought to Godspeed Horse Hostel, a 501c3 rescue where they received urgent medical care, and a careful re-feeding program in attempt to save their lives. It is a fact that animals that are severely malnourished often suffer long term medical problems, including improper development.
What are the betting odds the serious criminal animal cruelty case involving 20 severely neglected Thoroughbred horses, and 18 other animals by a New York Thoroughbred Breeder would be transferred from the Town of Clermont, New York to the Town of Ghent New York, which has local jurisdiction for Ghent, and the Chatham’s?
It appears the odds were about 20-1 the DA and/or Court would “select” transferring the NY Thoroughbred Breeder’s animal cruelty case to the Town of Ghent/Chatham in Columbia County. This long shot selecting the Town of Ghent to hear the NY Thoroughbred Breeder’s Animal Cruelty case appears to be no mistake.
Nussinow is a NY Thoroughbred Breeder. The Town of Ghent-Chatham is home to 3 of the largest NY Thoroughbred Breeding Farms in Columbia County, New York, encompassing over 1,600 acres, and warehousing hundreds of Thoroughbred racehorses.
The Medical Director of the lead animal cruelty investigation agency has a sprawling NY Thoroughbred Breeding Farm located in Chatham, N.Y. that sits on 600 acres, the second well-known NY Thoroughbred Breeding Farm is also located in the Town of Ghent situated on 695 acres, and its Farm Manager is a Councilman in the Town of Ghent, and the third largest Thoroughbred Breeding Farm located in the Town of Ghent is on 300 acres, and it appears its owners/relatives contributed heavily to Paul Czajka’s re-election campaign.
Aside from the DA/Court transferring the animal cruelty case of a New York Thoroughbred Breeder to 1 of 20 Towns/Villages in Columbia County, New York, which has 3 large Thoroughbred Breeding Farm, the conflicts of interest apparently reach the Judge in the Town of Ghent reportedly assigned to the case. What are the odds of this occurring after this case has been delayed, transferred to 3 different courts, and still has not been fully prosecuted by the District Attorney's Office ?

The Judge in Ghent New York reportedly assigned to this serious animal cruelty case involving 38 animals, including 20 Thoroughbred horses, with 12 dead animals, including a Thoroughbred broodmare, is reported to have family members involved in the New York Thoroughbred racing industry, personal friends with the Medical Director of the lead animal cruelty investigative agency, family owns a 50 acre NY Thoroughbred Breeding Farm in nearby Renesslear County, N.Y. and his family members have donated to the re-election of Paul Czajka, DA’s political campaign. What are the chances of the Town of Ghent/Chatham being selected to hear the NY Thoroughbred Breeder’s animal cruelty case?

What are the odds Paul Czajka, DA and or the Court would select a 20-1 shot to transfer the case to the Town of Ghent, home to the 3 largest NY Thoroughbred Breeding Farms in Columbia County, NY, with over a 40-1 shot the Judge would have ties to the NY Thoroughbred racing industry, and the Medical Director of the lead animal cruelty investigative agency, and assign an 8-1 shot the Assistant District Attorney assigned to prosecute the NY Thoroughbred Breeder, who himself his a Thoroughbred owner, and is 2nd Chairperson on the lead animal investigative agency board of directors, along with several Veterinarians on the CGHS Advisory Board involved directly with the NY Thoroughbred Industry, and members of the Breeding Association partially funded by Public monies to reward the NY Thoroughbred Breeder’s ?

In our opinion, this serious Animal Cruelty case against a New York Thoroughbred Breeder should have a Special Prosecutor assigned and removed from Columbia County, N.Y. due to the obvious conflicts of interest, which gives the appearance of Public Corruption to benefit a fellow NY Thoroughbred Breeder.
What are the odds justice will ever be served in this malicious animal cruelty case involving a New York Thoroughbred Breeder arrested 2 times for 46 counts of animal cruelty collectively, involving 86 horses and other animals, including 30 neglected Thoroughbreds as per the police arrest records, 12 dead animals, including 1 Thoroughbred brood mare, one botched Grand Jury, and a 15 million dollar lawsuit filed by the alleged animal abuser against the County of Columbia, CGHS, Perez and DeLisle with the taxpayers paying for all the associated legal expenses, and wasted valuable County and State resources ?
It certainly looks like a long shot that Paul Czajka, DA will ever prosecute this New York Thoroughbred Breeder’s animal cruelty case anywhere in Columbia County, or any jurisdiction saturated with NY Thoroughbred Breeding Farms controlled by wealthy horse associations involved in the multi-billion-dollar horse racing industry, unless there is an intervention by a higher New York State, or Federal Authority.
