We, the undersigned citizens, parents, students, and members of civil society, write to you with utmost urgency and concern regarding the prolonged illegal occupation of government land by SASTRA University, Thanjavur, Tamil Nadu, and its ongoing attempts to legitimise this unlawful activity.

Key Issues
SASTRA University Is Not a Charitable Institution:
Contrary to any claims, SASTRA University is a private higher education institution. It collects substantial tuition and other fees from students and operates for financial gain. It is not a non-profit or charitable organisation providing free education or service. This makes the occupation of public land ethically and legally indefensible.
Illegal Occupation of Public Land:
The University has occupied more than 31 acres of government land, part of a larger 58-acre parcel, since the 1980s. Government land is public property—it belongs to the people. Protecting it is a legal and democratic obligation.
Attempt to Legitimize Illegality Through Alternative Land:
The University has proposed giving the government an alternate parcel of land of equal size and claimed value, arranged by themselves, in exchange for legitimising their occupation.

This is ethically and legally unacceptable.
Courts must not accept this offer, as it would reward illegal action and set a dangerous precedent.
Public property cannot be substituted or negotiated after illegal occupation.
Misleading Students and Society:
By occupying government land illegally while charging substantial fees, the University misleads students into believing their education is legitimate and based on public service. This undermines trust in higher education and sets a harmful example.
Violation of Ethical Principles (Aram):
Tamil ethical traditions, including Thirukkural, teach Aram (uh-rum)—righteousness, moral duty, and justice. SASTRA University’s actions violate these principles and undermine public accountability.
Urgent Need for Judicial Intervention:

Immediate enforcement of recovery orders for the government land is required.
Explicit rejection of SASTRA University’s alternate land proposalmust be stated.
Strong guidance is needed to ensure education cannot justify illegal action, and that public property is protected.
Petition Request
In the interest of justice, public accountability, and the welfare of students, we respectfully request:

Immediate recovery of the illegally occupied government land.
Clear judicial rejection of the University’s attempt to legitimise illegal occupation through alternative land.
Strong legal and ethical clarification that education cannot serve as a shield for illegality, and that private gain from public land is unacceptable.
Measures to ensure that students focus on genuine education and civic duty, without being misled by administrative or legal loopholes exploited by the institution.
We urge the Hon’ble Supreme Court, the Bar Councils, State Governments, and civil society to act decisively and publicly, sending a firm message that public property, ethical education, and student welfare cannot be compromised for private profit.

This is not only a legal question but a matter of public ethics, governance, and democratic accountability.

தமிழ்நாட்டின் தஞ்சாவூரில் அமைந்துள்ள  சாஸ்திரா பல்கலைக்கழகம் அரசு நிலத்தை நீண்டகாலமாக சட்டவிரோதமாக ஆக்கிரமித்து வருவது மற்றும் இந்த சட்டவிரோத செயலை சட்டபூர்வமாக்க அது தொடர்ந்து முயல்வது குறித்து மிகுந்த அவசரத்துடனும் கவலையுடனும் கீழ்க்கண்ட குடிமக்கள், பெற்றோர், மாணவர்கள் மற்றும் சிவில் சமூக உறுப்பினர்களாகிய நாங்கள் உங்களுக்கு எழுதுகிறோம்.

முக்கிய பிரச்சினைகள்:

சாஸ்திரா பல்கலைக்கழகம் ஒரு தொண்டு நிறுவனம் அல்ல: எந்தவொரு கூற்றுக்கும் மாறாக, சாஸ்திரா பல்கலைக்கழகம் ஒரு தனியார் கல்வி/உயர் நிறுவனமாகும். இது மாணவர்களிடமிருந்து கணிசமான கல்விக்கட்டணம் மற்றும் பிற கட்டணங்களை வசூலிக்கிறது மற்றும் நிதி ஆதாயத்திற்காக செயல்படுகிறது. இது இலவச கல்வி அல்லது சேவை வழங்கும் இலாப நோக்கற்ற அல்லது தொண்டு நிறுவனம் அல்ல. இது பொது நிலத்தின் ஆக்கிரமிப்பை நெறிமுறை ரீதியாகவும் சட்டரீதியாகவும் நியாயப்படுத்த முடியாததாக ஆக்குகிறது.

பொது நிலத்தின் சட்டவிரோத ஆக்கிரமிப்பு:

இந்த பல்கலைக்கழகம் 1980களில் இருந்து 58 ஏக்கர் பரப்பளவின் ஒரு பகுதியான 31 ஏக்கருக்கும் அதிகமான அரசு நிலத்தை ஆக்கிரமித்துள்ளது. அரசு நிலம் பொதுச் சொத்து—அது மக்களுக்கு சொந்தமானது. அதைப் பாதுகாப்பது சட்டப்பூர்வமான மற்றும் ஜனநாயக கடமையாகும்.
மாற்று நிலம் மூலம் சட்டவிரோதத்தை சட்டபூர்வமாக்கும் முயற்சி: பல்கலைக்கழகம் தங்களது ஆக்கிரமிப்பை சட்டபூர்வமாக்குவதற்காக, அரசுக்கு தாங்களே ஏற்பாடு செய்த சமமான அளவு மற்றும் மதிப்புள்ள மாற்று நிலத்தை வழங்க முன்மொழிந்துள்ளது.

கணிசமான கட்டணம் வசூலிக்கும் அதே நேரத்தில் அரசு நிலத்தை சட்டவிரோதமாக ஆக்கிரமிப்பதன் மூலம், தங்கள் கல்வி சட்டபூர்வமானது மற்றும் பொது சேவையின் அடிப்படையிலானது என்று நம்ப வைத்து பல்கலைக்கழகம் மாணவர்களை தவறாக வழிநடத்துகிறது. இது உயர்கல்வியில் நம்பிக்கையை குறைமதிப்பிற்குள்ளாக்குவதோடு மட்டுமில்லாமல்  தவறான உதாரணத்தை ஏற்படுத்திவிடும்.

நெறிமுறைக் கொள்கைகளின் மீறல் (அறம்): 

திருக்குறள் உள்ளிட்ட தமிழ் நெறிமுறை மரபுகள் அறத்தை—நேர்மை, ஒழுக்கக் கடமை மற்றும் நீதியை—கற்பிக்கின்றன. சாஸ்திரா பல்கலைக்கழகத்தின் செயல்கள் இந்தக் கொள்கைகளை மீறுவதோடு பொது பொறுப்புணர்வையும் குறைமதிப்பிற்குள்ளாக்குகின்றன.

நீதித்துறை தலையீட்டின் அவசர தேவை:

அரசு நிலத்திற்கான மீட்பு உத்தரவுகளை உடனடியாக அமல்படுத்த வேண்டும்.
சாஸ்திரா பல்கலைக்கழகத்தின் மாற்று நில முன்மொழிவை வெளிப்படையாக நிராகரிக்க வேண்டும்.
கல்வி கொடுக்கிறோம் என்ற போர்வையில் சட்டவிரோத செயலை நியாயப்படுத்த முடியாது என்பதையும், பொதுச் சொத்து பாதுகாக்கப்பட வேண்டும் என்பதையும் உறுதிப்படுத்த வலுவான வழிகாட்டுதல் தேவை.

மனு கோரிக்கை:

நீதி, பொது பொறுப்புணர்வு மற்றும் மாணவர்களின் நலன் கருதி, நாங்கள்  கோருவது :

சட்டவிரோதமாக ஆக்கிரமிக்கப்பட்ட அரசு நிலத்தை உடனடியாக மீட்டெடுக்க வேண்டும்.
மாற்று நிலம் மூலம் சட்டவிரோத ஆக்கிரமிப்பை சட்டபூர்வமாக்கும் பல்கலைக்கழகத்தின் முயற்சியை நீதித்துறை தெளிவாக நிராகரிக்க வேண்டும்.

கல்வியை  சட்டவிரோதத்திற்கு கேடயமாக செயல்பட முடியாது என்பதையும், பொது நிலத்திலிருந்து தனியார் ஆதாயம் ஏற்றுக்கொள்ள முடியாதது என்பதையும் வலுவான சட்ட மற்றும் நெறிமுறை விளக்கம் அளிக்க வேண்டும்.
நிறுவனத்தால் சுரண்டப்படும் நிர்வாக அல்லது சட்ட ஓட்டைகளால் தவறாக வழிநடத்தப்படாமல், மாணவர்கள் உண்மையான கல்வி மற்றும் குடிமைக் கடமையில் கவனம் செலுத்துவதை உறுதிசெய்ய நடவடிக்கைகள் எடுக்க வேண்டும்.

பொதுச் சொத்து, நெறிமுறைக் கல்வி மற்றும் மாணவர் நலன் ஆகியவை தனியார் இலாபத்திற்காக சமரசம் செய்யப்பட முடியாது என்ற உறுதியான செய்தியை அனுப்பி, மாண்புமிகு உச்ச நீதிமன்றம், வழக்கறிஞர் கழகங்கள், மாநில அரசுகள் மற்றும் சிவில் சமூகம் உறுதியாகவும் பகிரங்கமாகவும் செயல்பட வேண்டும் என்று நாங்கள் வலியுறுத்துகிறோம்.

இது ஒரு சட்டக் கேள்வி மட்டுமல்ல, பொது நெறிமுறை, ஆட்சி மற்றும் ஜனநாயக பொறுப்புணர்வு சார்ந்த விஷயமாகும்.
