The Issue

The new bills introduced in March in the North Carolina legislature will have significant impact to all of North Carolina cities and towns. Their ordinances/regulations regarding new residential districts most likely will not apply.

It is important to respond quickly, the crossover for the Senate and the House is on 4/27/23.

Recently introduced North Carolina Senate Bill 317 states that it is addressing workforce housing shortages.  But it ultimately strips local government of their zoning and development planning rules to any residential development that provides 20% of said development to said workforce and first-time buyers.  100% of the development does not have to comply with local governments regulations, not just the minimum 20% required for a workforce housing development See page 3 line 6 of Senate Bill 317 First Edition.

“Except as provided in GS 160D-802.1, a local government may not implement or enforce a zoning regulation for a development that qualifies as a workforce housing development, including, without limitation, development standards regulating lot widths, setbacks, density, or building design elements”
