Issue: Ebensburg Borough residents are being negatively impacted by routine garbage/dumpster pickups. During Quiet Hours, residents are suddenly startled and woken up by loud and continuous noise coming from the garbage truck engine, back up beepers, air brakes, the truck picking up, dumping often pounding the dumpster to empty contents, then replacing the dumpster. 

Impact: Residents are startled by the loud noise and woken up. They are losing sleep. Residents are often unable to get back to sleep after the event. The repeated occurrence is causing sleep deprivation. It is occurring on a routine basis, at some locations up to 4 nights a week. That is 208 nights a year, 57% of all nights in a year. There is a direct negative impact on the Residents’ health, well being and quality of life.

NOTE: Historically, the Ebensburg Borough Council has taken the position that dumpster pickup is permitted due to a General Exclusion and Exception, in Section 8-208. E. "Necessary snow or garbage removal activities".

While snow removal activities as an exception IS NECESSARY due to the hazardous road and sidewalk conditions it causes. If snow is not removed there is a direct impact on public safety for the residents of Ebensburg, PA. 

Routine Garbage removal is NOT NECESSARY during Quiet Hours and has a direct impact on public health, safety, and well-being for the Residents of Ebensburg.

The Solution is simple: Move routine garbage dumpster pickups outside Quiet Hours to improve the quality of life for Ebensburg residents.

Findings; Purpose.  8-202 D.".......for the purpose of securing and promoting the public health, comfort, convenience, safety and welfare and the peace and quiet of inhabitants of the Borough.”
