I am pleased to inform you that on March 4, 2026, the Twenty-Fourth Collegiate Tribunal in Administrative Matters of the First Circuit unanimously issued a ruling in Recurso de Revisión 934/2025.
This appeal was filed by Dr. Oscar Gerardo Arrieta Rodríguez, Director General of the National Cancer Institute (INCan), along with the Delegate of the Responsible Authority, as well as Drs. Armando Tovar Palacio and Gerardo Gamba, in their capacity as members of the Honor Board and researchers at the National Institute of Medical Sciences and Nutrition Salvador Zubirán (INCMNSZ).
Main resolutive points:
- FIRST. The appealed sentence is confirmed.
- SECOND. The Justice of the Union grants and protects Dr. Alfonso Dueñas González.
- Important clarification: This amparo and its confirmation on appeal refer exclusively to the “warning” issued by the Honor Board of the Secretariat of Health (official letter DGPIS-115-2025 dated April 11, 2025). It does not resolve or affect the main disqualification procedure, which continues its course
Additionally, as of today, 13 corrections have been published to the questioned articles (at the time this petition was initiated, there were only 3), and several more are under investigation. This further supports the observations and concerns raised by Dr. Duenas-Gonzalez.
