REJECT EXTRATERRITORIAL TAXATION: DEFEND THE DIGNITY AND INDEPENDENCE OF THE TRAVEL INDUSTRY

As of October 1st, 2026, the new Maldives Inland Revenue Authority (MIRA) regulation has officially come into force. This law demands that every outbound Tour Operator and Travel Agency worldwide—regardless of their size or turnover (zero threshold)—must directly register with the Maldivian tax portal (Form MIRA 120), remit a 17% T-GST on their gross operating margin in USD, and submit to ongoing offshore financial compliance in Malé.

This risks to set an unacceptable, dangerous global precedent.

The MIRA regulation directly conflicts with WTO/GATS principles governing cross-border trade in services and OECD guidelines regarding Permanent Establishment. No foreign government holds extraterritorial jurisdiction to tax business profits generated by European companies operating within their home territories

While major trade associations express concern and search for compromises, independent operators are already taking concrete action. As revealed today in an exclusive report by the foreign press outlet Maldives Independent ("A revolt from Europe to Moscow as Maldives taxes the world's travel agents"), boutique tour operators have already begun halting sales, releasing uncommitted flight and resort allotments, and actively redirecting high-end client flows toward competing long-haul destinations.

Why this tax scheme targets the very core of our business model:

It denigrates professional advisory and consumer coverage: A European tour operator’s gross margin is not value created in Malé. It pays for local European office overheads, expert staff salaries, marketing investments, legal liabilities, and mandatory consumer financial guarantees under the strict EU Package Travel Directive. Claiming the right to tax this overseas margin implies that no value is added in origin markets to curate, market, guarantee, and sell the Maldives.

It imposes an unsustainable administrative burden: Expecting small and medium-sized European enterprises to manage tax filings and cross-border compliance with an offshore tax authority in a foreign currency for a few bookings a year is an operational nightmare.

Sovereign tax updates can be handled cleanly: As demonstrated by top-tier destinations like Fiji—which recently increased its VAT rate seamlessly—sovereign tax adjustments are traditionally collected directly at the local vendor level (resorts, local operators, and DMCs) without imposing administrative friction or mandatory registration on foreign organizers.


WHAT WE ARE DEMANDING:

To the Maldivian Government and MIRA: Immediately suspend the offshore registration requirement (Form MIRA 120) for non-resident foreign travel companies, and revise the mechanism so that any local tax is collected exclusively within the origin invoices of registered local DMCs and resorts.

To National Governments and European Authorities: We call upon our home government (Ministry of Tourism and Ministry of Foreign Affairs) to intervene diplomatically to protect domestic travel businesses from unfair extraterritorial tax enforcement and administrative overreach.

To Foreign Tour Operators and Travel Agencies: Stand united, sign this petition, and freeze active sales and promotions for the Maldives, redirecting your premium clientele to alternative destinations that respect the global distribution network and practice clean tax administration (such as Thailand,  Seychelles, Mauritius, and the Caribbean).

NO ALL'ESTRATERRITORIALITÀ FISCALE MALDIVIANA: DIFENDIAMO IL VALORE E L'INDIPENDENZA DEL TURISMO ORGANIZZATO

Il 1° ottobre 2026 è entrata in vigore la nuova normativa MIRA. La legge pretende che ogni Tour Operator e Agenzia di Viaggi nel mondo — senza alcuna soglia minima di fatturato (zero threshold) — si registri al portale fiscale maldiviano (Form MIRA 120), versi una T-GST del 17% sul proprio margine lordo in USD e sottostia ad adempimenti contabili oltreoceano.

Rischia di instaurare un pericoloso e illegittimo precedente globale

La norma MIRA viola apertamente i principi dell'Accordo GATS/OMC sul commercio transfrontaliero dei servizi e le linee guida OCSE sull'assenza di Stabile Organizzazione. Nessuno Stato estero può esercitare un'extraterritorialità fiscale punitiva sui ricavi generati da imprese Italiane ed Europee nel proprio paese di residenza.

Mentre molte grandi sigle cercano faticosi compromessi, la realtà del turismo indipendente sta già reagendo. Come riportato oggi dall'inchiesta della testata Maldives Independent ("A revolt from Europe to Moscow as Maldives taxes the world's travel agents"), c'è chi ha già scelto di fermare le vendite, rilasciare gli allotment e dirottare i flussi di viaggiatori verso destinazioni concorrenti.

Perché questa norma colpisce al cuore il nostro lavoro:

Denigra la consulenza e la garanzia d'agenzia: Il margine di un Tour Operator europeo serve a coprire i costi di struttura locali, gli stipendi del personale, la consulenza d'eccellenza, il marketing e le garanzie legali previste dalla Direttiva Pacchetti UE. Pretendere di tassare questo margine significa affermare che in Europa non viene creato alcun valore per ideare, garantire e vendere le Maldive.

Impone un'assurdità burocratica: Chiedere a piccole e medie imprese o agenzie boutique di gestire adempimenti contabili oltreoceano con un fisco estero è un ostacolo gestionale insostenibile.

Esistono modelli sani a cui ispirarsi: Come dimostrato da storiche destinazioni d'eccellenza come le Fiji — che hanno recentemente riadeguato la propria VAT senza creare attriti operativi —, gli aumenti fiscali si applicano e si incassano esclusivamente a monte sui fornitori locali (resort, trasporti, DMC), senza imporre balzelli contabili o registrazioni agli organizzatori esteri.

COSA CHIEDIAMO CON QUESTA PETIZIONE:

Al Governo delle Maldive e alla MIRA: L'immediata sospensione dell'obbligo di registrazione estera (Form MIRA 120) per gli operatori non residenti e la revisione della procedura, riportando l'incasso di qualsiasi imposta locale esclusivamente all'interno delle fatture dei fornitori e dei DMC in loco.

Al Governo Italiano (Ministero del Turismo e Ministero degli Affari Esteri): Di alzare la voce nei canali diplomatici e istituzionali per tutelare le imprese turistiche italiane da un'indebita ingerenza fiscale extraterritoriale che mina la competitività delle nostre PMI.

Ai Tour Operator e Agenti di Viaggio italiani ed europei: Di unire la voce, sottoscrivere questa lettera e congelare la promozione e le vendite sulle Maldive, dirottando i clienti d'élite verso destinazioni che rispettano la rete distributiva e la trasparenza fiscale (es. Thailandia, Seychelles, Mauritius e Caraibi).
