Stop KIUC Hydroelectric FERC Process
It is the responsibility of our community on Kauai to fully explore all possible sources of hydroelectric power.
In order to do this, we must engage in a delicate and respectful discussion that gives deference to the people and places that have ties to these waters in ways that most of us cannot comprehend. Traditional, Social and State protocols require that if we want to use the water that we must ask nicely. We must do this because it is not our water.
Free Flow Power is a group of pirates from Massachusetts that aggressively staked a claim on these water resources through Federal intervention, FERC. Now KIUC has paid the pirates the ransom to get our water rights back and then contracted these pirates as hit men to usurp the Hawaii State Water Law using the Federal FERC process. There was another event in Hawaii’s history, where a group of individuals used the U.S. government to forcibly acquire resources and power that they could not obtain through honest, respectful discourse. They too did not ask nicely, they just claimed it.
Only State Law protects our appurtenant rights to taro lands. Only State Law protects Native Hawaiian water rights and gathering rights. Only State Law protects water as a public trust for all citizens of Hawaii.
This is a defining moment for our community. It will set a precedent for how we again use our own resources to meet our energy demands. Please take the time to help maintain our dignity as a community.
We can do this by instructing the KIUC Board, through petition, to bring the Free Flow Power – FERC Action of March 29 to a vote by all members, and have a Special Meeting to discuss the proposed Action. A minimum of 250 member signatures are required on the petition to initiate the vote. Please take time do this.

I am a KIUC Cooperative member. Under Article II, Sections 2 and 6, I am hereby petitioning the KIUC Board to have the Action of Tuesday, March 29, to engage the mainland company, Free Flow Power, to secure rights to develop several hydroelectric projects under FERC, be submitted to the Members for a vote. Furthermore, I am requesting a Special Meeting be held to discuss this Action. I request that this Special Meeting be held during non-business hours so that Members may attend.
