The Issue

The beautiful and nostalgic town end  Pier Gardens in Cleethorpes, from  Sea view Rd to adjoining  Alexander Road to , Sea rd. have long been cherished by our community. Many of us have fond memories of leisurely walks in the gardens, enjoying the unique character and historic architecture that once made this area a special place. Unfortunately, these cherished grounds are now being jeopardized by plans for heavy duty excavations which threaten to strip the gardens of their natural beauty and historical significance.

We need to request  to Pause the town end ,Pier Gardens redesign and excavation,and Petition the  council to re allocate funding to the other end further along ,  down past the Swimming pool,where this reconfiguration and design may accommodate that area better, as the area is larger , However if you do Favour a refurbishment over heavy excavation it would be good to point this out, there  is no time to waist because the projects started.

If we can at least preserve the town end Pier gardens ,to have no more deep digging and excavation I think the Majority would go with this, its affecting to many lives and for a change that the majority did not want or request, Please be sure to contact your local Mp for Cleethorpes Melanie onn,and local Council project manager,

 Decision makers at North Lincolnshire Council ,and  underline you want to preserve the town end of Pier gardens to allow access and you feel the changes will be more suited at the other end towards the former  Fantasy island as that park ,is larger to accommodate the changes.

State you want to preserve and call a stop now to the town end of Cleethorpes Excavations and underline your reasons ..even arrange local meetings with your Mp whom can meet with you at your request and back your cause, I think altering the town end pier Gardens is not in the Community best Interest and has upset  and Inconvenienced to many people, whom never wanted the changes in the 1st place . Access into the Pier gardens town end would make everyone happy if they could start using it,as before without the 14 month wait, which is not practical ,and holiday season is now upon us, there is Few  Places where  for visitors to go if they cannot go through the pier gardens.

We need to get Maylam contracter moved on to the other end so the works then will not impact so many People , our elderly have lost quality of life amenity  due to these selfish changes ,the council may think there acting in Community  interest but it seems the Majority would rather this was not happening and to think theres 14 months to go ,write to your local Council now Call a stop and give your reasons if your serious do it now,and whatever  you do. (Do not give up.) also the omnibus takes complaints and can hold the council to account on the proof you provide of their Mismanaged failings.
These invasive excavations are not necessary for the revitalization of the town, nor do they serve the best interests of our beloved Pier Gardens. Instead, they pose a significant flood risk to neighboring properties due to their proximity to the sea.  we have already seen the devastation heavy machinery can wreak, removing the gardens' unique charm and closing off most of the area to the public.

Croft baker ward is your Seafront council, if you have not already you, should contact them right away challenging the ongoing works.state your reasons and request an emergency  stop and an in person appointment with them.

1st Request from the Council regular Environmental Impact Assessments ask the council to Provide any Scoping of Environmental Impact,that Specifically assess the long term Impact on Coastal erosion ,and tidal flooding as outlined.

2nd Request Hydrological Surveys,Challenge the developer to produce studies showing that deep excavations will not lower the effective Flood barriers for Alexander td ,Property  Engage                                                                                                                                                                                profession opinions on weather the excavated area will act a s a sink or conduit for sea water during high tide events.Reports of Flooding and Coast erosion from High tides are already being Reported.

3rd  Document local evidence Take photographs and videos of High tides. Water table levels,and existing surface water issues during rainy periods, and send them to the council flood risk department asap.

This then can prove long term damage and could stop the continuation of the project.

 An Emergency injunction  could  then be filed, if it is proven the continuation of the works is damaging and a significant flood risk,4th however this requires you to prove  irreparable damage will be caused if the work continues. then this can give way for a judicial review to be heard. 

5th Point  opens up the possibility of making the Council restore the Gardens to their former glory.(Misuse of Grant Funding.) If the grant was awarded for a Specific purpose, e.g Maintenance and the Council used it for a different purpose   (re design) the Funding body can demand the money back.although plans were in place since 2022,if you feel you were misinformed or the council did not anticipate the Impact it would have on business,and locals lives, causing loss of amenity also to the elderly these are things to challenge and hold the council accountable for.

If locals and  the public can prove the grant was mismanaged this puts immense pressure on the council.to rectify the situation.

Charging ahead with the project against the Majority wishes.

Ploughing these funds into an  area,that did not require this decree of extensive drilling spoiling the character of the park originality, town end Pier gardens did not need redesigning and assets removing using anti social behaviour as a banner,  refurbishment would have been a better option at a possible  lower cost,  the Council were eager to spend the money other wise the area would have missed out,but that   could be  a Misuse of the money without a doubt targeting the town end Pier gardens, re modeling and redesigning them the gardens became  the casualty  of this project and the funds could and should have been reallocated elsewhere to another part of Cleethorpes.

6th point.Public trust land if Pier gardens cleethorpes town end are deemed public trust land or open space, under the open spaces act 1906 there are strict limitations of what the council can do with them if it can be shown they breached this trust, a court can order the council to restore the land.

Point 7 Failure of Evidence of the Council used anti-social behaviour,as a cover to change the land use without sufficient  evidence, this can be highlighted in a judicial review to invalidate the decision..

So its up to you to supply the evidence, if you want to see the Pier gardens back to there former glory there is  no question the council failed to act on multiple occasions you now require to gather the evidence against them changing the Town end Pier gardens using grant money for redesign and changing it trajectory Forever. question ?

In accordance with the feedback and online the answer to this is yes. between april 2023 and March 2024 the Maze was removed as a public asset,for no other reason than council's lack of attention  of the gardens.

So at the time the Maze was taken out there were 36 Incidents logged for Pier gardens over the cause of 12 months .

11 incidents counted as antisocial  behaviour,6 public order Incidents ,Council sited this as Significant antisocial  behaviour.

Should the use of  allocated funds have been used  when they used anti-social behaviour as the guise to redesign the park ,putting events space over the needs of the community and not listening to you?

Stating they need space, and the focus had always been on redesigning the town and Pier gardens changing  town end under the guise of anti social behaviour. Not much transparency in that.

Moreover, the Pier Gardens are of scientific interest, home to diverse wildlife, birds, and plant habitats that are being disrupted by these unnecessary changes. The solution is simple and straightforward: we need to favor refurbishment and tidying up of the Pier Gardens, not heavy excavations. We call for the restoration of any removed architectural history, replacement of benches, planting of new trees, and general maintenance and return of Assets to return the town end of Pier Gardens and  to their former glory or at the very least Modification..

Final point to note for the Council actions to be considered a breach  or Maladministration if they misuse their planning powers to  ignore their statutory duties regarding Anti social behaviour(ASB)Learn how to escalate these issues through Social care,ombudsman,as appears to be the case hear or check official guidelines on the uk planning portal to see if rules have been broken .

If this proves to be the case you can hold the Council to account for this  by going through the social care omnibus to log your Complaint.

The Disproportionality Argument .The Council had used Antisocial behaviour Specifically ) in areas like Former Hedge Maze,they took it out and made it a pile of concrete justifying total renovation and aggressive landscaping official Police data often shows relatively  low figures,of reported crime compared to the extreme measures taken prior to  its removal  If Police records show only a few dozen incidents over a 12 Month period ) You can argue Mitigation(like cctv lighting or Park rangers would have fixed the Issue making removal disproportionate .

2 Councils statutory Failures   If the Data shows High levels on Anti social behaviour you can flip the narrative and use it as Concrete proof,of the councils failure to manage the area local authorities have a statutory duty  under the crime and disorder act 1998 to reduce crime and disorder if the ASB was rampant it proves the council failed to properly utilise existing preventative tools such as Failing to deploy wardens ,Park rangers or dedicated care takers.

Failing to enforce existing public spaces protection order consistently .

Failing to invest in sufficient lighting or cctv despite public requests.
