Stop HB 454: Abortion and Miscarriage Criminalization Act

The Issue

Around 1 in 4 pregnancies end in miscarriage, 30% of fertilized eggs fail to implant, and 1 in 4 women will have an abortion in their life time; the state of Alabama thinks this equates to homicide.

HB 454 would grant personhood to fertilized eggs. It would charge anyone who has an abortion with murder. It would also allow the state to investigate and charge people for miscarriage if they are in a situation that could cause "duress or neglect " and miscarry. Who gets to define duress? -if you work a high stress job and miscarry, is that enough to prosecute you for murder? If you miss a doctor's appointment and you miscarry, is that enough to constitute neglect? 

This bill also allows the AG to prosecute if a DA refuses to. If you put yourself in a situation that could cause "duress or neglect " and miscarry, they will prosecute you. Who gets to define duress? If you work a high stress job and miscarry, is that enough to prosecute you for murder? If you miss a doctor's appointment and you miscarry, is that enough to constitute neglect?
Finally - this guarantees that no medical provider will ever perform any service that might save a pregnant person's life out of fear of jail for ending a pregnancy.
We know if this law comes to pass, it will harm the most marginalized in our state. That is what they want. We cannot allow this bill to take effect.
