Stop Smith County Texas Judicial System Corruption! The People have had enough!

The Issue

Smith County Texas has had a long history of Judicial Corruption. Should you have an  unfortunate encounter with the judicial system there (including the Sheriff’s Office, Jail, Judges, DA, Public Defenders Office, and Probation), you can forget the concept of Due Process of Law & being innocent until proven guilty. One of the best known cases of extreme corruption in Smith County is the case of my friend, Kerry Max Cook, who was framed and spent 22 years on death row. Although DNA evidence has proven his innocence, the District Court has refused to officially overturn his verdict and clear his name. His case well documents one of the most extreme instances of judicial fraud, misconduct, and corruption in American history. There are countless others that have gone unnoticed. A few examples of Smith County’s tyrannical judicial system include…

Judges regularly force pre-trial probation on defendants as a condition of bond. It is not lawful to punish defendants before they are found guilty. They bend laws to suit their needs or force defendants to “voluntarily” sign up for a costly pre-trial diversion program. If you object, you are told you’ll either comply or go back to jail to await trial. If you must submit to drug tests and probation officers, where is your right to remain silent? And how about those probation fees? Should you get probation, expect to pay over $300 per month. Judge Kerry Russell regularly raises bail bonds once a defendant is indicted - even if they have complied with their bond conditions, showed up for arraignment, and hired an attorney. It’s a well established law that bail bonds are not to be used as an instrument of oppression. I’ve seen mentally ill defendants locked up for 2 years without a court date! They are held in jail waiting for a bed in a mental hospital for two years while the jail collects money for housing then!!! Bail amounts in Smith County are disproportionately high for the crime compared to other counties in Texas. 

There are countless stories of police misconduct, judicial corruption, and complete disregard for the law. A Smith County judge “made an example” of a man by sentencing him to 16 years in prison for stealing a candy bar, which is more than the law allowed for the crime. Most people are afraid to speak up and demand their rights for fear of retaliation. The few that do speak up are quickly silenced with intimidation and fear tactics. Haven’t you had enough?
