Dear Friends,

                    Congratulations on crossing 7500 signatures. We are marching ahead with our staunch opposition to Profits over people and hope to win this  battle with your support and active participation . These are important updates 

  1. On Monday , 06/24/24 , there was a rally outside RMC which was joined by firefighters, first responders, nurses , physicians , community leaders  and staff. Here is the link to the press coverage https://youtu.be/pCQdnk62NhQ?si=vLf2lUFF03xI6pli
  2. Finally after persistent efforts by Coaltion partners , there is written response by California Department of Public Health expressing their inability to do anything due to lack of legislation . Here is official response     (We support equitable access to hospital care for all communities, but, while the Department of Public Health must be notified by facilities about the facility’s intent to discontinue supplemental (optional) services or close, we have no authority or legal means to deny their plans. Every general acute care hospital is required to provide eight basic services: medical, nursing, surgical, anesthesia, laboratory, radiology, pharmacy, and dietary services. The law only requires that hospitals provide a public notice of an intent to close, reduce, or eliminate supplemental services, which includes emergency medical services, maternity care, pediatric care (including neonatal ICU), psychiatric care and services, and stroke services). Therefore we have dropped CDPH from list of  receipeints of this petition . 
  3. This petition is now addressed to our Hon'ble Governor Gavin Newsom to provide required legislation so that CDPH and other agencies can prevent this health care crisis being deliberately inflicted on underserved diverse population of east santa clara county. It is a loophole which has to be plugged in on emergency basis. We should recall The Terri Schiavo case, a patient with vegatative state on feeding tube . There was concern about starvation due to removal of the feeding tube at the request of the husband.  On October 21,2003 the Florida Legislature, in emergency session, passed "Terri's Law". This gave Florida Governor Jeb Bush the authority to intervene in the case. Gov. Bush immediately ordered the feeding tube reinserted.  Second time , emergency legislation was made at federal level on March 21, 2005 Congress passed a bill, S.686, that allowed Schiavo's case to be moved into a federal court. The controversial law is colloquially known as the Palm Sunday Compromise. It passed the Senate on Sunday afternoon unanimously, 3-0, with 97 of 100 Senators not present. Meanwhile, in the House of Representatives, deliberation ran from 9pm EST to just past midnight during an unusual Sunday session.The bill was passed 203-58 (156 Republicans and 47 Democrats in favor, 5 Republicans and 53 Democrats against), with 174 Representatives (74 Republicans and 100 Democrats) not present on the floor at the time of the vote at 12:41 a.m. EST. President Bush returned from vacation in Crawford, Texas to sign the bill into law at 1:11 that morning . So there is precedent that to save one patient from starvation, emergency legislations were made at State and Federal levels. In East San Jose, we are talking about approximately 20 patients daily who will undergo serious harm or even some fatalitiesCan we ask our elected officials to rise to the occasion and follow the moral and ethical standards set by their predecessors ? Make Emergency Law to save RMC closure now and plug the loophole. 
  4. This petition is also addressed to our Attorney General Rob Bonta.  For a fair comparison, if PGE , which is for profit company, decides to give 110 volts to affluent areas and 55 volts to less affluent areas, would that be acceptable ? 55 volts wouldn't light up some of the lights , washer/dryer and many other essential appliances in the house.  We are sure that Attorney General won't like this inequity . In the same way, why trauma/comprehensive stroke/STEMI programs important for HCA to roll out in affluent areas and not in relatively less affluent areas? RMC and GSH, 2 hospitals are just 15 miles apart and you can see huge difference by the same corporation  for resources and quality of services . People are being discriminated openly. We humbly request Attorney General to intervene immediately. 
  5. We invite you to join Unity Rally to Save RMC  planned on july 9th at 5.30 pm in front of RMC where hundreds if not thousands Doctors, Nurses , Nncillary staff Fire fighters, EMS,  Prominent citizens , Board of Supervisors of Santa Clara County, Politicians as well as Public will show unity in stopping RMC closure. We will protest democractically . Your presence is very vital and we would request you to join with your family and friends. Together We Win. Please mark your calendors. Details to follow
