Stop 65' Foot Cellphone Tower In Residential Zoning District

The Issue

For the attention of Fountain Hills Mayor Gerry Friedel and the Fountain Hills Town Council.

This petition is to deny Special Use Permit  SUP24-000008, proposing to erect a permanent 65' foot tall multi-antenna cellphone tower (fake palm tree) and a temporary "Cell on Wheels" (COW), in a Fountain Hills Neighborhood.

The location for the proposed tower, is Generation Church located at 16239 E Ironwood Drive, Fountain Hills, Arizona, on the corner of Fountain Hills Boulevard and Ironwood Drive. The Church is located on a residentially zoned lot and in a Neighborhood Property Owners Association (NPOA) area. This location is surrounded by single family homes. 

The purpose of this petition, is to inform the Fountain Hills Mayor and Town Council of our opposition to the Special Use Permit application submitted by Crown Castle and T-Mobile, requesting to waive the existing Fountain Hills  Zoning Ordinance in order to erect a 65' foot tall tower in a neighborhood, which is residentially zoned R135.  

The Fountain Hills Zoning Ordinance does permit 65' foot tall Palm Cell Towers on commercially zoned property. Other 65' foot tall fake Palm Tree Cell Towers in Fountain Hills are currently located at storage facilities and other commercially zoned properties, not family neighborhoods. If you would like to see one, simply drive down Saguaro Blvd and look above the Alamo.  

We the residents, families, property owners and community, have serious and founded concerns for the negative impacts that high power telecommunication antennas and towers, will inflict on those in its vicinity. These concerns are why we choose to live in a residential zone, protected by the Town of Fountain Hills Zoning Ordinance and not, in a Commercial Zone, where 65' foot cell tall towers and other types of businesses are permissible.  


Some of the adverse impacts and unreasonable conditions affecting 
residents by the proposed 65' foot tall multi-antenna (Palm Tree Cellphone Tower) and temporary (Cell On Wheels) Permit  are:

  1. Extremely undesirable visual impact on Fountain Hills Neighborhoods and beautiful natural surroundings by the 65' foot tall multi-antenna cellphone tower (Fake Palm Tree) and the (Cell On Wheels), as both are an aesthetic blithe. 
  2. Residential property values decrease in the vicinity of such industrial equipment.  
  3. Public safety concerns for Increased wildfire hazard because of a 65' foot tall multi-antenna tower, especially near desert wash areas. 
  4. Public safety issues surrounding exponential increases in microwave emissions, just feet away from homes, with exposure from (6) new antennas, where more antennas can be added in the future. 
  5. Violation of laws which safeguard threatened and endangered wildlife species, that are documented as living in Fountain Hills.
  6. Approval of this Permit by Town Council would set a precedent for additional 65' foot tall multi-antenna Palm Cell Towers in other residential area, throughout Fountain Hills. 


Additional violations of the Zoning Ordinance: 

  1. The Tower exceeds the residential 30' foot height structure limit by 35' feet. 
  2. The Cell on Wheels exceeds the 30' foot height structure limit by 21' feet.
  3. The Tower would violate the 200' foot required separation distance from any single family residential unit.
  4. The Tower is within 300' feet of residentially owned property.

T-Mobile has a net value of over 275 Billion Dollars and has the resources and ability, to locate a site for a 65' foot tall multi-antenna cellphone tower, away from occupied residential homes and in compliance with the Zoning Ordinance. Note; T-Mobile/Crown Castle's application specifically states that a “site ring” search for alternative locations was not conducted.

We, the undersigned, respectfully request that our Town Council and Mayor Gerry Friedel, utilize and enforce the existing Fountain Hills Zoning Ordinances, to protect and preserve public safety and the aesthetic beauty of our neighborhoods and community, by denying T-Mobile / Crown Castle's Application for Special Use Permit SUP24-000008.
