The malpractice, malafide, fraud in building commencement and occupancy certificate is done by:

1. Mohan Lifespaces LLP, Builders and Promoters, Sales Manager Prashant Rai

2. Architect Thorat Mathew and Associates,

3. Ambernath Municipal council Town Planner Vidyasagar Chavan and Chief Officer Bhalchandra Gosavi they allotted fake Commencement letter of a building and 31 building are constructed by builder.

4. Ulhasnagar Town planner Prakash Mule and Ambernath Council Chief officer Devidas Pawar they allotted fake occupancy certificate mentioning completion date as 2 April 2016 and letter issued date is 17 January 2020, whereas building were not completed on 2-April-2016 they were completed in year 2019, 2020 and 2021.

Why Special Investigation Team and Anti Corruption Bureau, Enforcement Directorate is required for investigation.

1. To investigate the Corruption, Malpractice, fraud, irregularities done by above mentioned person causing huge revenue losses to Government against Commencement fees, development fees, scrutiny fees, fsi fees, premium FSI fees and other applicable charges if any and to recover it. 

2. To investigate the issues faced by owners due to poor, inferior quality construction done by contractors and responsible architect and engineers which builder is denying to repair, builder should make necessary repair work.

3. Till date No Property taxes are collected by Ambernath Municipal Council property taxes for Mohan Nano Estates are pending since possession given in Year 2019, 2020, 2021, 2022, 2023. I Have personally shared the Occupancy Certificate with the Chief Officer Mr. Prashant Rasal and Mr. Prashant Shelke but necessary amendment has to be done in Occupancy Certificate as per actual date of Completion so that owners can pay property taxes.

4. No Further sale of apartment should be allowed until and unless the documents are corrected as per Government norms by collecting necessary Commencement fees and other charges if applicable from the builder.

5. No Private, PSU, Co-operative banks should give loan to this project until all documentation are rectified.

6. Detail investigation is necessary for all the projects registered under MahaRera for Mohan Nano Estates and Mohan Suburbia as common Commencement letter is uploaded for 31 building constructed

7. Also prior projects completed at Mohan Suburbia before Rera implementation are a matter of investigation to recover Commencement fees and property taxes

I have brought this concern in front of authorities since last more than six months but adequate measure and action yet to be taken, Special Investigation Team, Anti-Corruption Bureau, Enforcement Directorate should be appointed to investigate this malpractice and for necessary legal action.

Builder is denying to repair / replaces tiles which are fixed poorly causing water leakages as per Rera Act its mandatory to repair the property if damages are due to builder negligence.

Internal Structural Audit by MahaRERA and Maharashtra Housing Department should be done on immediate basis and the issues faced by Flat Owners should be resolved at the earliest.
