The Issue

After years of navigating the family court system as part of a blended family, we have witnessed first-hand how the system is skewed towards mothers, regardless of the circumstances or evidence presented. Our struggle, like that of many other fathers, has resulted in significant emotional and financial strain—continuously needing to prove worthiness for regular contact with our children. It's disheartening when undeniably loving fathers are sidelined by a system that fails to appreciate their importance in a child’s life.

Many fathers are committed to being actively involved in their children's healthcare, schooling, and important life decisions. However, the current legal framework forces us to endure protracted court proceedings, often leaving us marginalized. In family court cases, the term "best interests of the child" should truly reflect the need for a child to have equal access to both parents who are willing and capable of providing care and support.

The bias towards awarding primary custody or influencing parental rights should no longer unfairly disadvantage fathers. Research consistently shows that children benefit significantly from the involvement of both parents. For example, a study published in the Journal of Family Psychology highlighted that father involvement is linked to better emotional, social, and cognitive development in children. Ignoring the role of fathers can deprive children of these benefits, potentially leading to long-term impacts on their development and well-being.

We call for reforms to ensure that fathers are included equally in familial decisions right from birth. This means simplifying processes for shared custody and ensuring that fathers can access the necessary legal support without recurring court procedures each time an important decision needs to be made. The aim is not to undermine the role of mothers but to establish a fair and balanced approach that acknowledges the valuable contributions of both parents.

Changes must include training for judges and legal professionals to recognize implicit biases and reform in the application of laws that currently disadvantage fathers. By doing so, we can foster an environment where decisions are made genuinely in the best interest of the child, allowing for healthier and more balanced family dynamics. This also includes Cafcass, Social Services and Social Workers, Healthcare professionals and Schools.

We urge those who have the power to reform this outdated system to do so with urgency and compassion. Please sign this petition to support equality for fathers in family court decisions, ensuring they are heard, valued, and included in every aspect of their children’s lives and not made to feel inadequate as a parent. Mothers should not take precedence over a father.

This is why we want to pass #Stephenslaw to give hope and fairness to fathers in the UK.
