The state says that the officer makes the call if they want to test for drugs or alcohol in a car accident if they think the driver is acting normal they will not test them which is ridiculous because a lot of people under the influence can act normal. Jesse Owens of Greeley has previous charges and court dates for meth later on there was meth found in the car they would not test him because he was acting normal but his injuries suggest that he was high at the time he rolled the car and killed my baby girl and they are only pressing misdemeanor charges With careless driving resulting in a death he was driving on a revoked license, he knew he wasn't supposed to be driving had no Car insurance and was running from his court dates leaving state with the minor And still they would not test him, charges should be vehicular homicide  Because him know when he was driving with no license should be reckless driving which falls under the guidelines of vehicular homicide.  Please sign the petition and change the state law making it mandatory in a fatal accident for the driver to be tested no matter how they are acting.  To get the right kind of Justice for Montana the laws need to be changed for future accidents
