We recently spoke to the mediator assigned to our fight against Santa Land and Cattle Co LLC/Western New Mexico Land Company. The mediator came off very pushy and refused to put the reason for his call in writing after we expressed that we were not available for mediation until July 1, 2020. After relentless calling (it’s been 5 months since Santa Rita has refused to pay the mediation fee), we called the mediator back after canceling a revenue-producing meeting. We made the mediator aware of the limited 30 minutes we had available for the call and informed him that we had another meeting scheduled in 30 minutes.

The mediator proceeded to discuss the case with us during this time.

  • He attempted to discourage us from holding any weight to the recent filings submitted against Santa Rita as a result of seeing they had not paid the mediation fee as of 3 months after several orders were sent out by the judge.
  • The mediator had no knowledge of the civil rights violations brought to the attention of the court because he hadn’t read any of the motions we’ve filed in the last 2 years.
  • The mediator was unaware of the fact that the Mooney’s were not delinquent when this case was opened by Santa Rita and payments were denied by Santa Rita and Quest Title Company.
  • The mediator was unaware of the fact that proof had already been submitted of Santa Rita’s affiliation with our criminal accusers. He was unaware that the Mooney’s have been fighting criminal charges as a result of prejudice, discrimination and retaliation carried out by Santa Rita and their racist militia affiliates.

The mediator let us know that mediation in cases with civil rights violations are not typically successful. We let the mediator know that we were willing to discuss and clarify all the details of the case he was not aware of at another time. We will post updates as they come in. We are LITERALLY fighting this company, Santa Rita/Western New Mexico Land Company, to defend the rights of our black and brown brothers and sisters. This company is controlling hundreds of acres of land that was stolen from the indigenous peoples of this area, WE deserve to have a FAIR opportunity to buy it back. And if this company is going to stand in the way of black and brown rights, we will do everything we can to encourage Cibola Count District 13 Court and Judge Villalobos to hold Santa Rita accountable for conducting business illegally within the county and violating the civil rights of 2 law-abiding, family business owners.
