

On February 8th we received a letter from the Court Clerk outlining the determination made by the court on 3 of the filings related to our fight to remain on the land, retain the land for our own, and stop part of the hate group that has targeted us since the day we arrived in New Mexico.
Judge Rael ruled on Santa Rita Land and Cattle Co's request to have us ejected off the property without any court process was denied. However, we filed a Motion to Override the Civil Contract and an Answer and Counterclaim that the Judge rejected because it was not filed with the court properly. There have been more motions filed with regard to this case so the case will continue on. We will need to retain legal counsel going forward to ensure that our case isn't thrown out on the basis of the lack of information on how to legal pro se process worked in New Mexico. If anyone is in the position to assist us build up a fund to retain a lawyer (since HUD Housing Authority will not return any of our calls or inquiries) to ensure that we don't lose this property and that we don't have to pay rent for the time that we've been here without paying due to the fact that Santa Rita denied payments from us and 2 other parties that offered to cure our debt to ensure we didn't lose our property.
Finally, we are asking that if you are unable to donate to our fund today or anytime soon, please contact HUD Housing Authority and let them know that you don't agree with the racism and discrimination Daniel and Cristina Mooney are receiving, you feel that HUD should help represent us in court and CALL US BACK! We've been trying to reach out to them since August and they will not respond no matter how much we call, so now we need to fill their voicemails with our presence! Please help us do that!
