We've been having to deal with the seller, who has taken us to court after taking over half of our past due payments, has been driving by taunting and watching us on our property over the last couple weeks. On October 8th it got so bad that we had to call the police and file a criminal complaint for harassment and stalking. Cibola County Sheriff's Department came out and took a report, they also let us know that until the Court has made a determination and an eviction order has been filed we have rights to be on the property and the seller should not be driving by since there is no property for sale at the end of our road. During this harassment on October 8th one of my dogs was almost run over by the guest car that drove along with the seller who is evicting us. 

On October 11th we checked the NM Courts website and found out that the seller's lawyer filed an Answer with Cibola County District Court and never provided us with a copy, per the law. We had to obtain our own copy of what was filed on our own, which required us to drive an hour into the city. On top of that, the seller has filed another motion asking the Court to make a judgment against us without a court hearing on the basis that we didn't pay by the date specified. This is the 2nd or 3rd answer or motion that completely blows over the fact that we made payments when the seller filed this lawsuit against us and after we were told that if we were making payments our contract/account would not go delinquent.

While we were putting together the response to that outrageous request, we found out that we also meet the requirements of a counterclaim on the basis that they accepted payments to the late balance and have made false statements on documents filed with the court. So we also filed an Affidavit and a Counterclaim with Cibola County District Court. 

We're holding space that Judge Rael will allow us to still have a hearing on November 6th and defend our right to shining the light on the truth of this matter. Discrimination, racism, and hatred will not be countered in silence, we need our voices to be heard!
