For over more than a decade, the State of FL and the County of Volusia have been clearing vegetation and leveling spoil piles in the Mosquito Lagoon Basin in the name of restoration. The purpose of the work was to undo the drag-line ditching from the 1950's and 1960's. During the 2015 permit cycle of the work, Webster Creek Development Inc. established a claim of ownership of more than 300 acres of, already restored or to be restored, land and submitted an application for a mitigation bank. The US Army Corps. of Engineers rejected the application in September 2016, partially because the claim of ownership was based on sketches and an unsigned/unsealed survey, but also because hydroblasting will result in "unavoidable impacts to US waters". Despite rejection from the Corps., the State of FL is still reviewing the application and has encouraged the applicant to resubmit to the Corps.. As unusual as this may seem, the head of the regulatory agency (SJRWMD) reviewing the application, is also the owner of the consulting firm representing Webster Creek Development, Inc..
