My fellow law-abiding citizens

Thank you for standing up for what we know is right, moral, and ethical.
While we prepare our letter to the board of Clicks consider this from The Organisation for Civil Liberties

In terms of South African law the definition of extortion is as follows :

'Extortion consists of taking from another some advantage by intentionally and unlawfully subjecting him to pressure which induces him to submit to the taking. ' The essential elements are these, advantage, intention, pressure, unlawful subjection to pressure, and inducement.

Therefore, through a process of violence, vandalism, and intimidation the EFF brought pressure to bear on the Clicks and Unilever which resulted in them giving something to the EFF that which they would ordinarily not have given them. What they got and how much of it is not relevant in terms of the law. Extortion and racketeering is a criminal offense in South Africa and falls under the Prevention of Organised Crime Act of 1998.

What is worse in this situation is that Click’s and Unilever facilitated the extortion by acceding to the demands of the EFF.

We can only assume that the CEO’s of the respective organisations being Vikesh Ramsunder for Clicks and Luc-Olivier Marquet for Unilever signed off on any agreement reached with the EFF and therefore they are guilty of facilitating a crime.

In terms of the Combating and Prevention of Corrupt Activities Act 12 of 2004 the person who pays the bribe or gives the favour is equally as guilty as the person/organisation that demands it.
