STOP SMDC Sea Residence' CORRUPT Condo Corp.'s implementation of 7-night minimum rentals!

The Issue

STOP Greenmist, the Sea Residence Condo Corp. and SMDC from invading the rights of unit owners to rent their units at a marketable rate to get their investments back and to accommodate vacationers, most of them, returning OFWs!

Proposed by Greenmist Property Management Corporation, SMDC Residence Condominiums' Board of Trustees have approved unreasonable and unjust rules for handling leasing of units at Sea Residences in Pasay City and other properties as well. These procedures will take effect beginning February 28, 2017. 

Had we seen his coming, we would never have bought any condo units at any of SMDC properties. We were promised a return of investment from renting our condo units. Would you still buy at SMDC now that you are aware of these rules?

Below are the contents of the Sea Residence Condominium Circular No. 2017, dated June 9, 2017, which majority of homeowner did not even receive. There was never a meeting held with any unit owners who are automatic members of the Condo Corporation,  as per the Master Deed and Declaration of Restrictions. 

Leasing of Units

  1. All lease contract shall be for a minimum of seven (7) days: (Comment: On an average, guests only stay for 2 nights since most of them come from abroad (OFW's) and just need a temporary and affordable place to stay upon their arrival in Manila and before their flight back to another country. They choose to stay in our condos because of the affordability compared to hotels.)
  2. All requirements for lease shall be processed and submitted to the Property Management Office (PMO) one (1) day prior to the actual move-in/out of your tenant.

Requirements are as follows:

 For Move-in

  • Duly signed and notarized lease contract (Shall be signed by registered owner and/or authorized representative):  (Comment: To notarize a document, all signatories must appear in person at the notary. The tenant only arrives on the day of their booked stay. As per second rule, "All requirements for lease shall be processed and submitted to the Property Management Office (PMO) one (1) day prior to the actual move-in/out of your tenant." Is Greenmist suggesting that we forge the signature of the guests?)
  • Duly accomplished Move-in form

For Move-out

  • Duly accomplished Move-out form
  • Payment of P100.00 per transaction: (Comment: No objection)

Corresponding penalties shall be applied for non-compliance
      a. A Penalty of P1,500.00 shall be given to the unit owner if: 

i. Completely filled up form was not submitted at least three (3) days before arrival. (Comment: This conflicts with rule #2)

ii. No signature from registered unit owner/authorized representative or guest/s when submitted to the Property Management Office.

iii. Contract of lease is less than seven (7) days.

      b.  Posting/advertising on travel sites that a unit in Sea Residences is being offered for lease shorter than seven (7) days.

i. A Notice shall be sent to the Unit Owner, reminding them of the House Rules and stating the sanctions that the Condo Corp. may impose to any Unit owner who is violating this rule.  The Unit Owner will be asked to sign an “Undertaking” stating that the unit is not used for transient operations. 

ii. After 1 month and post has not been revised, a second notice shall be sent to the Unit Owner. The unit owner shall be given forty-eight (48) hours to explain why they should not be penalized for violating the rule. If after 48 hours, the Unit Owner still failed to send a formal reply/explanation to the Notice, a penalty of P15,000.00 shall be charged.

iii, After another month and post has not been revised, a Notice of Disconnection of Water Supply shall be served upon the unit owner. Water supply shall be cut-off within three (3) days from receipt of Notice and will only be re-connected upon full payment of the penalty.

  • Our listings will not be visible to, or booked by people who search for rooms for less than 7 days. This will obviously affect the number of inquiries and bookings we receive. 
  • How will the Notices be sent to owners, when even these important circulars do not even get to our mailboxes?
  • How will the Condo Corp conduct a search of all units' Travel Site listings? Will they consume their time on a witch-hunt rather than focusing on how to make their paperwork more work-efficient?
  • Shouldn't they care more maintaining the common areas? 
  • Why would they disconnect our Water Supply when we are paying our monthly dues?
