ARREST DONALD J. TRUMP FOR HIS ROLE IN THE JANUARY 6, 2021 INSURRECTION

The Issue

We The People, having witnessed in real time on live television the assault on our U.S. Capitol building in Washington D.C. on January 6, 2021, immediately following a rally in support of 'The Big Lie' claiming that the 2020 election was "stolen" via "fraud" which was widely & openly promoted by Donald John Trump et al, and the attempted assault on our entire Congress, as well as the sitting Vice-President Mike Pence, do hereby request that the US AG Merrick Garland & the Department of Justice, in association with the January 6th Committee and United States Attorney for the District of Columbia Matthew M. Graves, issue an arrest warrant for Donald John Trump on the following charges: 


* Violation of 18 U.S. Code § 2383 - Rebellion or insurrection

Whoever incites, sets on foot, assists, or engages in any rebellion or insurrection against the authority of the United States or the laws thereof, or gives aid or comfort thereto, shall be fined under this title or imprisoned not more than ten years, or both; and shall be incapable of holding any office under the United States.

 Violation of 18 U.S. Code § 2384 - Seditious conspiracy

If two or more persons in any State or Territory, or in any place subject to the jurisdiction of the United States, conspire to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the United States, or by force to seize, take, or possess any property of the United States contrary to the authority thereof, they shall each be fined under this title or imprisoned not more than twenty years, or both.


* Violation of 18 U.S. Code § 2385 - Advocating overthrow of Government

Whoever knowingly or willfully advocates, abets, advises, or teaches the duty, necessity, desirability, or propriety of overthrowing or destroying the government of the United States or the government of any State, Territory, District or Possession thereof, or the government of any political subdivision therein, by force or violence, or by the assassination of any officer of any such government; or

Whoever, with intent to cause the overthrow or destruction of any such government, prints, publishes, edits, issues, circulates, sells, distributes, or publicly displays any written or printed matter advocating, advising, or teaching the duty, necessity, desirability, or propriety of overthrowing or destroying any government in the United States by force or violence, or attempts to do so; or

Whoever organizes or helps or attempts to organize any society, group, or assembly of persons who teach, advocate, or encourage the overthrow or destruction of any such government by force or violence; or becomes or is a member of, or affiliates with, any such society, group, or assembly of persons, knowing the purposes thereof shall be fined under this title or imprisoned not more than twenty years, or both, and shall be ineligible for employment by the United States or any department or agency thereof, for the five years next following his conviction.

If two or more persons conspire to commit any offense named in this section, each shall be fined under this title or imprisoned not more than twenty years, or both, and shall be ineligible for employment by the United States or any department or agency thereof, for the five years next following his conviction.

As used in this section, the terms “organizes” and “organize”, with respect to any society, group, or assembly of persons, include the recruiting of new members, the forming of new units, and the regrouping or expansion of existing clubs, classes, and other units of such society, group, or assembly of persons.


* Violation of 18 U.S. Code § 1505 - Obstruction of proceedings before departments, agencies, and committees

Whoever, with intent to avoid, evade, prevent, or obstruct compliance, in whole or in part, with any civil investigative demand duly and properly made under the Antitrust Civil Process Act, willfully withholds, misrepresents, removes from any place, conceals, covers up, destroys, mutilates, alters, or by other means falsifies any documentary material, answers to written interrogatories, or oral testimony, which is the subject of such demand; or attempts to do so or solicits another to do so; or

Whoever corruptly, or by threats or force, or by any threatening letter or communication influences, obstructs, or impedes or endeavors to influence, obstruct, or impede the due and proper administration of the law under which any pending proceeding is being had before any department or agency of the United States, or the due and proper exercise of the power of inquiry under which any inquiry or investigation is being had by either House, or any committee of either House or any joint committee of the Congress shall be fined under this title, imprisoned not more than 5 years or, if the offense involves international or domestic terrorism (as defined in section 2331), imprisoned not more than 8 years, or both.

18 U.S. Code § 2331 - Definitions: 

(5) the term “domestic terrorism” means activities that—

(A) involve acts dangerous to human life that are a violation of the criminal laws of the United States or of any State;


(B) appear to be intended —

(i) to intimidate or coerce a civilian population;

(ii) to influence the policy of a government by intimidation or coercion; or

(iii) to affect the conduct of a government by mass destruction, assassination, or kidnapping; and

(C) occur primarily within the territorial jurisdiction of the United States



* Violation of 18 U.S. Code § 2381 - Treason

Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States.

Levying War is defined as: 
"Levying war means the assembly of a body of men for the purpose of effecting by force the overthrow of the United States government or to resist its laws. Those who assemble to levy war, as well as those who conspire with them, can be prosecuted. All who perform any part, however minute, or however remote from the scene of action, and who are leagued in the general conspiracy, are considered as engaged in levying war, within the meaning of the Constitution."



Categories of speech that are given lesser or no protection by the First Amendment (and therefore may be restricted) include: speech integral to illegal conduct, speech that incites imminent lawless action, and speech that incites sedition and/or insurrection against the United States of America.

Insurrection is defined as:
"A rising or rebellion of citizens against their government, usually manifested by acts of violence. Under federal law, it is a crime to incite, assist, or engage in such conduct against the United States."

Sedition is defined as: 
"Sedition refers to the act of inciting revolt or violence against the government. It includes overt conduct, such as speech and organization, that tends toward rebellion against the established order of the governing authority. Sedition may include any commotion, even if it is not aimed at direct and open violence against the laws."



TRUMP KNEW that Congress was under siege at the U.S. Capitol by his supporters, whom he personally invited to come to Washington DC on January 6, 2021 in several social media posts (and other electronic communications), and who were collectively chanting "Hang Mike Pence" while attempting to stop the constitutionally required certification (see Twelfth Amendment) of the 2020 Presidential election results, and Trump did nothing for 187 MINUTES to stop the violent insurrection that he inspired, stoked & encouraged. He then attempted to prevent an investigation of the events that led up to the insurrection. And, when he could not prevent the investigation, he did everything he could think of to subvert the bipartisan January 6th Committee's work by ordering his associates to defy subpoenas and by filing lawsuits without merit  to stall the procedures. We believe that this constitutes a federal felony!
