The community would like to see this irresponsibly owned establishment closed due to the the constant code violations, the condition of the exterior, and the recklessness of its patrons.

The owners of this bar/restaurant don’t respect our neighborhood or the codes set in place for establishments operating in this area and as a result the patrons have followed suit. We feel it is creating an unsafe environment in the neighborhood and is drawing criminal activity and behavior that should not be accepted in the residential area it resides. 

According to the NPU there have been over 5 shootings resulting in 4 deaths in the last 11 months associated with this club. As a close resident myself, on June 19th I witnessed over 12-15 shots fired around 3am. Police and ambulances were dispatched to the area, and then the following Sunday there was additional gunfire. 

The most recent and troubling incident happened on August 8th in broad daylight. The gun battle and fighting spilled out into the streets and bullets shot out the windows of the Fresh Market across the street and struct vehicles on Peachtree Road. Families with children shopping were terrorized and could have been killed. Residents in nearby apartments have reported bullets reaching their residences in the past as well. There is constant loitering, fighting and drug use in the Benihanna parking lot where patrons pay and are allowed to park. Residents do not feel safe to walk and now drive past this area when the club is operating.

The building itself doesn’t comply with the Bureau of Code Compliance and is badly dilapidated. The exterior walls and patio are in a bad state of repair. The is paint is peeling and there is ripped fabric hanging from the arbors. To create privacy for patrons they have installed reversed Astroturf to the fencing attached with plastic cable ties. There is excessive rubbish and trash visible from the curb on the patio. There is exposed electronic equipment that is a fire hazard. There is broken glass enclosed around the entrance. The fence that was recently damages by a vehicle involved with the recent shooting has not been repaired or even cleaned and tidied up. 

In 2019 they plead nolo contendere to a noise violation citation and paid a fine of $425. Not only did the noise violate code restrictions, but contained profanity and explicit lyrics that could be heard throughout the neighborhood. And yet they continue to violate this ordinance most nights till 4am. 

They are in violation of liquor licensing code ordinances.  They have multiple ads offering free drinks and frequent drink specials durning certain hours which are violations. The club operates after 2am, and although have not confirmed, but would not be surprised if they are serving alcohol after hours. 

And last but not least, this bar is violating Business Codes for the area by hosting stripper events with adult entertainers in attendance and offering specials on private rooms. 

In 2019 there have been 100 calls to 911 associated with the address. I am currently still waiting for this years report.
