Grant Clemency to Dwayne Stewart for his Unknowing Participation in a Crime

The Issue

This is an attempt to receive justice for an innocent man who was wrongfully convicted of a crime he did not commit. On July 24th 2008 Dwayne Stewart (32), was charged with aggravated malicious wounding, shooting in a occupied building, possession of a firearm, robbery, and grand larceny.


On the night of December 3, 2007, Stewarts associate Brandon Smith exploited him in order to commit a heinous crime. Smith asked Stewart to take him to the home of the victim.

Unbeknown to Stewart, Smith’s intention was to murder the person in that home as retaliation.

Stewart did not fire a gun the night of the shooting nor was he aware of what was going to take place. Despite that, Stewart has been incarcerated for 13 years serving a 18 year sentence. To this day, Dwayne Stewart has maintained his claim of innocence and is fighting for his freedom after being wrongfully convicted. 

 In July of  2019, Brandon Smith wrote an affidavit admitting that he alone commited the crime. He states that, “...everything was my fault and was done because of me. I tricked and manipulated the others as part of my hidden agenda to take revenge on Mr. Gorham”.

Dwayne has not been able to be a father to his son, over this crime that was committed by Brandon Smith. Smith, has agreed to take a lie detector test to confirm his actions. Stewart has moved forward with asking for a conditional pardon. Evidence used to convict one person, shall also serve its purpose in proving anothers innocence. It was written clearly and mentioned several times that Dwayne Stewart was another victim in this crime, because he was hoaxed into being an unknown party to a heinous crime.
