Nationstar Mortgage - stop your fraudulent practices and report my good payment history!
The Issue
Dear Mr. CEO of Nationstar, Nationstar Shareholders, and CFPB Ombudsman,
Like many American homeowners, I struggled a bit after the collapse in the housing market in 2008. My mortgage wound up being transferred to Nationstar as a result.
I should tell you something up front, before I go any further into my story: I happen to know what FCRA, FDCPA, UDAP and UDAAP are because I have to take classes and pass tests on these laws and policies every year to keep my job. I regret to inform you that your company, Nationstar Mortgage, is violating every one of these laws and policies in my case.
I have made all of my payments on time, every time since getting back on track in December of 2015. Yet, through the process of trying to refinance to a lower interest rate (I am paying 7%), after months of Nationstar soliciting me to refinance, I was informed by Nationstar DBA Green Light Loans that my payment history with them for the last twelve months is "unsatisfactory." I immediately provided my re-fi coordinator at Nationstar/Green Light an export of my payment history from Nationstar's own systems as well as my bank records that prove the payments have all been timely, as well as a Federal court order stating that my loan was current as of December 2015 and that there were no arrearages. In fact, I also provided a certified letter, filed with Federal court from Nationstar's counsel stating his agreement on behalf of Nationstar.
And yet...nothing has been done.
I was made aware two days ago that Nationstar is not reporting my good payment history to the credit bureaus. In fact, Nationstar has reported my loan as collection status showing NO PAYMENTS at all for the last 13 months. In fact, the last time Nationstar reported anything on my account was 2010. It also shows I have a zero balance. Feel free to reflect that on my account, the one I have paid on time every month.
I found this out around the same time I was notified by my re-fi coordinator that, due to my "unsatisfactory payment history" the underwriters rejected me and my loan product would be changed. In fact, my credit score is terrible now despite having almost no debt aside my mortgage and paying it on time, every time as I do all of my obligations.
Your company, whether it was an intentional act to drag down my credit score to charge me a higher interest rate or trap me so no other lender will touch me, or completely inadvertent or negligent, it is a violation of all of these laws I referenced above to have done this. It is another violation each time I have reported it to your company and the issue remains uncorrected.
That I have notified my re-fi coordinator on Nationstar's own recorded line as well as in writing and nothing has been addressed makes me think this is not an accident or negligence. If it is, it surely is not being addressed.
You have no right to tank my credit to justify charging me a higher interest rate. You have no right to tank my credit for your company's own negligence. And that is also against the law whether intentional or negligent.
Own your mistake, if it is not an intentional act, and report my positive payment history to all 3 credit bureaus immediately. And you might want to take care of that before you close my re-fi at an artificially inflated interest rate due to your company's refusal/negligence in reporting accurately. It'd be a shame for your company to make $200,000 more in interest on my loan by charging me an artificially high interest rate when your own company is to blame for my credit score.
I now understand why there are social media pages filled with hundreds of people you have done this and other fraudulent practices with. I now understand why when I looked you up on the BBB website, there is a red letter warning outlining your fraudulent practices.
Fix your mess. Report my positive payment history. Stop trying to make extra money on me for a mess YOU created.
I am MORE THAN HAPPY to provide you with all of the written correspondence and documentation of this issue that I have provided since November of 2016 that proves my case.
