Limit Presidential Pardon Power for Administration or Campaign Officials
The Issue
Currently the Constitution states that a President "shall have Power to Grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment." This has left open a loophole in the form of a President offering a reprieve or pardon to members of his or her own staff that commit crimes in the President's name so that he or she can obstruct Impeachment proceedings.
We propose adding an amendment to the Constitution of the United States with the following language:
"A President may not grant a pardon or reprieve to members of his or her own administration, campaign staff, or any others contracted by the President during that President's tenure or in the campaign preceding his or her election, or in the interim between election and his or her swearing in as President."
We believe that this will help combat corruption by future presidents by making it difficult to abuse pardoning powers to obstruct future investigations into Executive misconduct.
It is not a blanket ban on pardoning people who worked for a given President. Other Presidents may decide to pardon or reprieve a previous administration's convicted criminals. However, it will ensure that a President cannot use pardons as a bargaining chip with his or her own staff who are under investigation.
Once there are a million signatures, this will be sent to Congressional leaders and Senators.
