Selinsgrove Area School District administrators recently began permitting students of one sex to use restrooms, locker rooms, and shower facilities of the opposite sex if they self-identify with that gender, despite having single-user facilities already available for any student who wishes to use them. 

The District did this earlier this year, without school board action, and without informing the parents or community until a letter was sent home on October 17th, 2016; without open discussion or any communication to the parents until after the fact. Parents received a letter stating the new policy is set by the Department of Education and Justice and that our district would lose its federal funding if we did not comply. We will not lose federal funding for continuing to protect students’ privacy in restrooms, locker rooms, and showers.

There is currently a Nationwide, federal injunction in place to stop the federal government from pulling funding from schools for this reason.  In addition, the U.S. Supreme Court just entered an order permitting a school to continue to maintain restrooms and locker rooms based on biological sex, which will remain at least until the court hears that case next year!  Our school should follow that lead, and continue to protect the bodily privacy of students in multi-user restrooms, locker rooms and shower facilities, while the Supreme Court waits to hear that case.

***We, the undersigned, ask that the Selinsgrove Area School District Board stop the new practice of permitting students of one sex to use the bathroom, locker rooms and showers of students of the opposite sex based on how they identify their gender.  We ask that they go back to permitting all students to use multi-user bathrooms, locker rooms and showers of their biological/anatomical sex, and to permit any student who desires greater privacy to use single-user private facilities if they prefer that.  We want to ensure the safety and protect the right to privacy of each and every student.***
