Subject: Public online signature petition seeking an independent and impartial inquiry into the alleged damage caused to graves, trees, and cemented fencing post pillars at Kabristan Ahle Muslimeen, Mathura, a gazetted waqf notified property being Waqf No. 74 and Waqf No. 858, by the entry of a JCB/heavy machinery; reopening of IGRS Complaint No. 40014526013809 ; restoration, compensation, fixing of accountability, and prevention of any recurrence.
Sir/Madam,
We, the undersigned citizens and online supporters, submit this public petition to seek urgent, fair, and effective administrative intervention in relation to the serious damage allegedly caused at Kabristan Ahle Muslimeen, Mathura, which is a gazetted waqf notified property being Waqf No. 74 and Waqf No. 858.
Based on the available facts, the statements of the affected families, and the visual material shared publicly, serious allegations have arisen that, during works connected with or undertaken through the Mathura-Vrindavan Municipal Corporation, a JCB/heavy machine was caused to enter the kabristan premises, resulting in substantial damage to several graves, large trees, and the security infrastructure, including the cemented fencing post pillars. Such an incident is not merely a matter of physical damage. It raises grave concerns relating to the dignity of the deceased, protection of religious sanctity, preservation of waqf property, administrative accountability, and the rule of law.
It is a further matter of serious concern that IGRS Complaint No. 40014526013809 is stated to have been closed on the basis of an allegedly false, incomplete, or misleading report. If the complaint has been disposed of without hearing the affected parties, without a fair and transparent site inspection, and without proper examination of the available evidence, such closure is contrary to the principles of natural justice, administrative fairness, and public law accountability.
Accordingly, we, on behalf of the online signatories and supporters, respectfully seek the following reliefs:
- That IGRS Complaint No. 40014526013809 be immediately reopened and subjected to an independent, impartial, and record-based inquiry.
- That a joint site inspection be conducted in the presence of the affected families, local witnesses, relevant administrative authorities, kabristan management, and the contractor’s representatives, and that such inspection be video recorded.
- That all damaged graves be restored and repaired in a dignified, lawful, and time-bound manner, with due regard to the sanctity of the burial site and the sentiments of the affected families.
- That the damaged/broken cemented fencing post pillars and other security structures be immediately repaired, reconstructed, or replaced so as to restore the safety and boundary protection of the kabristan.
- That the role of the Mathura-Vrindavan Municipal Corporation, its concerned officers, and, where applicable, the relevant contractor/agency, be examined and responsibility be fixed, and that appropriate departmental, civil, and legal action be taken against any person or entity found responsible.
- That appropriate disciplinary action be taken against any officer or employee found to have submitted any false, misleading, or factually deficient report in relation to this matter.
- That the affected families be granted appropriate compensation and restitution for the religious, emotional, structural, and related harm suffered by them.
- That, for the future, a clear, transparent, and lawful protocol be established governing the entry of heavy machinery into any kabristan/waqf premises, and that no such entry be permitted without prior competent written authorization.
- That a detailed Action Taken Report in relation to this matter be formally shared with the complainants/representatives and, where appropriate, be placed in the public domain.
We submit that the protection of a gazetted waqf notified kabristan is not merely a private concern of the affected families. It is a matter of public interest, religious freedom, human dignity, lawful governance, and institutional accountability. Immediate and effective intervention is therefore necessary.
In the event that timely and fair action is not taken, the affected families and concerned citizens may be constrained to seek appropriate remedies before competent judicial and statutory forums, including, where necessary, by instituting proceedings before the Hon’ble High Court by way of a writ petition and/or public interest litigation (PIL).
We therefore request that this public online signature petition be taken on record and that immediate necessary action be initiated.
