Seeking justice for Benny killed in a Tesla accident
The Issue
My brother Benny's life was tragically cut short in October 2025 when he was hit and killed by a a girl named Cass Garcia driving a Tesla. This devastating incident has left a gaping hole in our families' hearts, and we are struggling not only with grief but with the glaring lack of justice in this case. Benny was a nurse, a graduate of Texas Tech and a kind and loving man whose smile lit up any room. His life was taken too soon.
The girl who hit and killed Benny said she "fell asleep at the wheel" was not detained or even questioned thoroughly at the scene. Shockingly, no toxicology tests were administered, and she was allowed to leave without charges. How can this be right? How can someone’s life be taken, and yet no comprehensive investigation follow?
The absence of immediate toxicology testing raises serious concerns about the potential impairment of the driver. Why was this standard protocol not followed? Why was she allowed to go home without a thorough examination or accountability?
We need a thorough investigation. We demand that the Dallas police department revisit Benny's case with urgency and ensure that all necessary tests and procedures are conducted with rigour. Every person deserving of justice should have a system that acts fairly and without bias, but it feels that Benny has been let down by the system that promised to protect us all.
We plead with Dallas police department and the district attorney's office to look into this case with fresh eyes. Ensure that justice is not just a word, but an action taken for Benny.
I am asking for your help to ensure accountability is served and to prevent any other families from feeling the immense pain and frustration that ours is enduring. Please sign this petition and help us seek justice for Benny.
