THE AAMCO INVESTIGATION

SEND TIPS 202-885-4444

By Tisha Thompson and Rick Yarboroug

AAMCO admitted in open court when ask by the judge if he had giving to me a written estimate before working on my Jaguar they answered “NO” thereby violating the law. Judgment is entered against Defendants AAMCO and HIS Automotive Repair, Inc., jointly and severally for failure to provide a written estimate of the cost of work on Plaintiff Tyrone Merritt Jr.'s vehicle in violation of The Business and Professions Code Section 9984.9 and for

substandard work on Mr. Merritt's vehicle. The amount of the judgment is $3,830, reflecting the amount that Mr. Merritt paid Defendants for the work on his car ($3,500), plus the amount that Mr. Merritt paid a third party to diagnose the problems with the car after Defendant's' work was completed. Mr. Merritt also is awarded costs of $130.00. By not giving to me a written estimate before working on my Jaguar AAMCO violated. Bennett v. Hayes , 53 Cal.App.3d 700

But instead of just paying the judgment AAMCO decided to appeal it after admitting the judge wrongdoing. This appeal is in bad faith, AAMCO has no grounds to appeal. They are just harassing him and holding on to my son money who has just enlisted in the U.S. Air Force. He is doing his best to prepare for graduation with his Bachelor of Science Degree in Criminal Justice and at the end of June starts his training to serve this nation proudly.

In my opinion the patterns and practices of this company describe. (RICO) These are well documented on link to complaints below and a majority of the complaints say the same thing I sued aamco about the bait and switch quote you one price and charge you another without giving a written estimate and  this is illegal. I ask this if the same crime is taken place over and over throughout the U.S.  under this corporations banner AAMCO why not investigate if it smell like popcorn more likely it's popcorn. I believe this is a RICO case that the D.O.J. should investigate. For civil claims brought by private parties who have been victimized by a criminal organization, the burden of proof is less onerous than in criminal court. A preponderance of the evidence standard applies. This means the jury must find that it is at least slightly more likely than not that the racketeering activities did in fact happen as alleged. Despite the lower burden of proof, civil RICO lawsuits are difficult and expense for individuals to pursue. Those who win are rewarded, however. Successful plaintiffs can recover “treble damages,” or in other words, three times the amount of money they lost due to the defendant’s actions.

The Racketeer Influenced and Corrupt Organizations Act, commonly referred to as the RICO Act or simply RICO, is a United States federal law that provides for extended criminal penalties and a civil cause of action for acts performed as part of an ongoing criminal organization. They have been sued before using this law below.

AAMCO is a Horshman, Pa.-based franchisor of transmission and automotive repair centers. It and American Driveline Systems, American Capital LTD and American Driveline Centers are defendants in the case, which was brought by Thomas W. Furlong Jr. of Maryland and Gustavo Soto of Colorado in U.S. District Court for the Southern District of Illinois under the Racketeer Influenced and Corrupt Organization (RICO) Act.
