My son, Joseph Alexander Clarke, whom I love so darely was taken from me at the age of 23, today he's 31 an has been wrongfully locked up since December 6th, 2016. He leaves behind his only child Savanna, who needs her father, she was 2 years old when he was arrested and a big family and many friends who loves an cares an misses him daily and wants him back. I haven't seen my son since then. He is currently located at dooly state prison in the state of Georgia, His GDC Number is 1002736404. 

Every day, once I get up, I get on my knees an pray & beg God to please protect Joseph an please bring Joseph back home to me. I have tried everything I can possibly do to getting my son home an nothing is working, I've even paid 2 lawyers ( Rachel Kaufman & Thomas Robinson ) to help my son & both of them did nothing but taken my hard earned money an helped my son get convicted. Thomas Robinson never cared to even visit my son an really knew nothing about Joseph's case, basically i paid both of them to do nothing. 

Please can someone help me to get my son out of Georgia's dangerous & inhumane prisons and back home to me in New York, his conviction must be overturned A.S.A.P. please before to much time passes an he loses us his only support or we lose him or I fear worst that he is murdered in prison by another inmate due to all the violence an homicides happening in Georgia's prisons which is no secret you can simply Google an find multiple recent stories of inmates in Georgia prisons constantly being stabbed to death by other inmates, or beat to death, or tied up missing for days or forced to commit suicide due to the conditions an frustration an etc. There is also organizations just like one by the name of " They Have No Voice " you can find them on Facebook: ( https://m.facebook.com/groups/459692547765168/ ) who is bringing awareness to the world about the: Violence/injustice/unlawful/unconstitutional matters along with cruel an unusual punishments an lenghty excessive sentences an just so much more. Right now as we speak The Department of corrections is under an open investigation by The department of justice due to this an more.

I need help an i need it quickly. I am getting old an I am now unemployed an struggling. I'm a mother of 6 & It's been almost 8 years my baby has been taken from me, I'm so heartbroken an stressed out an depressed an torn apart. I still can't believe this is reality. 

My son Joseph, was wrongfully convicted of a murder he did not commit - a crime that allegedly took place all the way in sandy springs Georgia on Thanksgiving night of 2016 but my son Joseph; was at home in Brooklyn NY with me an our family for Thanksgiving night of 2016 like he always is every year. I got proof/evidence of a flight ticket of my son Joseph arriving in NY that same month of November of 2016, I also have documents of him completing community service which was 2 whole weeks long in that same month of November of 2016, I also have a letter from our private doctor he goes to and a letter from the day care Provider for his daughter, both affirming his good character and behavior an the fact he was seen an in New York all of November of 2016, along with Me ( His mother ) and many family an friends of ours that will an has previously all stated he was home in Brooklyn NY for Thanksgiving of 2016. To add to that Joseph has no criminal record nor has he ever been in jail or prison, he doesn't live in Georgia an has only visited there a few times in search for a cheaper an better living. 

• At my son Joseph Alexander Clarke's trial in January 2020, a NYPD gang task force member came from New York to Georgia & took the stand an failed in proving that my son was apart of any street gangs but Fulton county still went ahead & charged an convicted my son for gang participation, also at his trial it was proving that the weapon used to commit the actual murder of 1 person was never in Joseph's possession, he was not seen with it an never used it but Fulton county still went ahead and charged him for possession of that weapon an another weapon an convicted him of both, oh by the way, one person supposedly was murdered that night and they charged Joseph for 5 murders! and convicted him of all, sounds ridiculous right? Yeah, sad but this is the truth, he was convicted of 14 charges in total.                                                   

• There is absolutely no concrete proof beyond a shadow of doubt proving my son Joseph committed any said crimes within indictment number: 17-SC-151466 to had convicted & sentenced my son to LIFE IN PRISON PLUS 30 YEARS! but yet he was still convicted off of a simple statement that changed multiple times ( just view the discovery of the case, i still have copies of it here at home ready for inspection ) a statement from a victim by the name of ( TYRIQUE LOBBAN ) whom he himself Don't know what actually happened from reading the case's discovery, nor can he be trusted due to his criminal record an the fact that all evidence proves he's actually an active gang member an he was just on the run about 2 years ago for shooting someone in Atlanta, was then later arrested an now out on bond to the best of my knowledge.                                                                

• Joseph is not known for being violent ever and has no criminal record so The very skilled an trained professional prosecutors could only make up lies to make my son seem like someone bad because no evidence could do so. Also, This we recently discovered that Joseph's indictment is fraudulent and was not brought back in open court; it also has no grand jury records. I myself, an my son Joseph, currently have proof from the clerk of Fulton county Superior Court, stating there are no grand jury records filed with the clerks office for indictment number 17-SC-151466. The clerks office directed us both to ask Fulton county district attorney's office if they may have such records an we sent them multiple F.O.I.A. and Georgia Open Records Act even by certified sign an return receipt mail an still to this day we never got 1 response from the district attorney office.

Listen you guys, in order to indict any case in America there must be public records of 1. a grand jury being called in to duty, 2. The grand jury being sworn in, 3. The grand jury answering to their names after the deliberations in order to bring a lawful indictment about, an these records must be public for inspection which in Joseph Alexander Clarkes indictment number 17-SC-151466 these records does not EXIST. And yes I have all the proof to back that up. So that means my son is not only wrongfully convicted but also unconstitutionally convicted an his conviction is actually void ab initio.

In the past, family members of ours made gofundme accounts for my son, trying to raise funds to get him professional proper legal help an finances to help pay to get Joseph home, GoFundMe not to long after the page raised over 200.00$ ( two hundred dollars ) took down his funding page an stated they do not raise funds for legal issues.  

If possible, I am asking for financial support so I can get my son Joseph a good lawyer, one who actually cares an wants to help Joseph, an once we've gotten Joseph a good lawyer anything extra will go to him being able to have commissary an finances waiting for him once he gets released that he can start a new chapter being able to get back on his feet, getting himself a car an apartment an being able to take care of his daughter until he's stable like he was before he got taken from me.

Joseph is also not from Georgia, he's from New York, born an raised an has no one in Georgia, all of his love ones are here in new York an due to the distance it's almost impossible to do much for him, I haven't seen my son since he's been locked up an taken away from me.

This case represents an egregious miscarriage of justice that must be rectified immediately to prevent further harm to my innocent son and our family who have already suffered immeasurably due to this wrongful conviction.

I do speak to my son daily, an he of course stays out of trouble and away from bad company, he's the president over toastmasters communication class, he goes to the law library every Monday, he also gets involved in as many classes as possible just to stay positive an get the best out of this horrible situation. He prays daily an has no Disciplinary reports & he is not known for being a bad prison even in prison. He does tell me horrible stories of things that constantly happens around him or at other prisons in Georgia an how they are serving nasty disgusting stuff they call food for them to eat, he says he Don't eat hardly anything they serve there so I do try hard to make sure he has commissary often. Due to him finding out the meat they served them since he was in Fulton county jail was coming out of boxes labeled " not for human consumption " he had stopped eating meat an majority of stuff served. He also said they barely give out fruits an vegetables an proper foods with the nutrients our bodies need, an how the pipe water is contaminated. Basically prison is set up to kill the inmates that are there, after a while it will effect you in some way, and my son said he's trying his best to not allow the conditions to damage him, but still his mental health has already been damaged. 

We call upon the residents of Brooklyn, NY - where we reside - along with the residents of the state of Georgia where Joseph is currently locked up at for almost 8 years now as well as people everywhere who believe in justice to support us during this challenging time by signing this petition.
