Bobby Don Salas has been wrongfully imprisoned since 2002 for a crime that NEVER even happened. Bobby’s girlfriend at the time , Heidi Breitbach, was a student at the University of River Falls in Wisconsin. The nightmare began when Heidi’s jealous roommate filed a false report stating that Bobby had brutally assaulted Heidi. Since this never happened, Breitbach filed a report against the roommate. The roommate manipulated 2 other female students into filing similar false reports.One of these women ended up recanting her story and refused to testify on behalf of the prosecution at the Salas trial.

While the investigation of this alleged crime was going on, Heidi became pregnant with Bobby’s child so they moved in together. Several months later, they broke up and Heidi moved into a place of her own. Heidi had decided that she did not want Bobby to have any contact with his  child. He let her know that wasn’t going to happen and that he would be seeking full custody of the baby citing she was not fit nor stable enough to be a parent. To this Heidi informed him, “Yeah? Well, I have a plan to make sure that you never see my child.” Making good on that threat, she contacted the detective handling the false charges that were made earlier by Heidi’s roommate. However, Heidi embellished the false accusation by saying that she had been sexually assaulted as well as brutally beaten.

On appeal, Bobby’’s appellate attorney stated, “ Mr. Salas has already explained that Heidi’s credebility was the central issue in this case; there were numerous reasons to doubt it. She had motive to lie. She gave numerous inconsistent stories  and her testimony seemed improbable at best.”Heidi had more that one reason to lie plus the strong possibility of a psychiatric problem. Bobby was the fourth man that she claimed sexually assaulted her within a six year period. Every 2 years she claimed that someone else had sexually assaulter her; Bobby is the only one that she filed formal charges against.

There were many problems with several others involved in his trial. He court appointed attorney practiced civil law, not criminal law and he did not  disclose that the alleged victim’s sister was one of his clients. During the jury selection he did not object to two of the jurors who were friends with Ms. Breitbach and  a female juror who was the neice of the trial judge.

This is a case of actual innocence where Salas was convicted of a crime that never even took place.There is evidence that  proves  a miscarriage of justice  took place and continues to do so everyday that Bobby Salas is locked up in prison.
