DEFUNDING PLANNED PARENTHOOD WI IS A FEDERAL CRIME!

The Issue

WISCONSIN STATE GOVERNOR SCOTT WALKER HAS COMMITTED A FEDERAL CRIME! 

According to the Medicaid Free-Choice-of-Provider guarantee, "any individual eligible for medical assistance... may obtain such assistance from any institution, agency, community pharmacy, or person, qualified to perform the service or services required... who undertakes to provide him such services." 

It is a FEDERAL CRIME for Scott Walker to block funding to Planned Parenthood and its affiliates in Wisconsin.  In May of 2011, Indiana legislature passed House Enrolled Act 1210 (HEA 1210) that prevented entities that perform abortions from receiving state funding for "health services unrelated to abortion" - this included cancer screenings, PAP tests, STD testing, and family planning services. 

HOWEVER, Planned Parenthood of Indiana and other plaintiffs filed a lawsuit the same day alleging that the law violated federal Medicaid law. AND THEY WON!! 

"These practices were contrary to Medicaid’s goal of expanding access to health-care providers and inconsistent with Medicare. Therefore, in response to states’ restrictions on access (as well as a general outcry from providers), Congress adopted a Senate provision clarifying the free-choice-of-provider
protection."

On June 1, 2011, the Centers for Medicare and Medicaid Services (CMS) REJECTED Indiana's state plan amendment on the grounds that the amendment violated the free-choice-of-provider requirement. 

WISCONSIN: IT IS TIME TO STAND IN SOLIDARITY WITH PLANNED PARENTHOOD AND ITS AFFILIATES!

Tell state legislators and Planned Parenthood board members to file a lawsuit against Scott Walker on the grounds that defunding this organization violates a federal law.
