Not surprisingly, OREA hasn't taken any specific actions after receiving a letter from the legal team at McMillan LLP, dated October 24, 2023.
At this time, I'd like to inform you that, after discussions with the lawyer, two individuals have filed complaints with the Ontario Human Rights Tribunal. These complaints suggest that the implementation of the ORWP will cause systemic age and disability discrimination. The complainants applications highlight how the ORWP is discriminatory and have therefore asked, that as a remedy, the Tribunal compels OREA to make changes regarding the mandatory fee/ORWP policy. They have also asked that a requirement be made of OREA to create a policy on human rights and further, that OREA provide training for its leaders.
The people making the complaints have agreed to let us share this with you because they want you to know about these important steps. They've asked the Tribunal to schedule their hearing as soon as possible, given that January 1, 2024 is right around the corner.
The legal team has continued to gather and complile information to support this and other legal challenges. There are still people who don't even know about the ORWP! Or who think it is optional. Because in a fair and just world, we'd have a say in our self-interests.
We need to fight this, not because of the cost or inadequate plan, but because this may just be the first in many moves that OREA makes, using us as their unsuspecting pawns. Getting away with this will only embolden them to use us to support their agenda.
Many real estate professionals are worried about the ORWP. Your suggestions and advice have been greatly appreciated; McMillan LLP is taking effective legal actions using the limited resources wisely. Fundraising has reached about 42% of the goal. It is grossly out of my comfort zone to say this but
WE NEED TO RAISE MORE MONEY!
It is CRITICAL to secure financial backing to throw the full weight of the court at this association before they make their next demand. Perhaps this is just the start to a plan that sees OREA turning the reigns over to TRREB to take up their new position as "insurers".
