Victoria Barracks is protected under the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) only because it is on Commonwealth land.

If the site is sold:

It immediately loses its EPBC Act protection
It ceases to be a Commonwealth Heritage Place
It falls into a regulatory void, because NSW planning and heritage laws do not automatically apply to former Commonwealth land
Its nationally significant heritage values become vulnerable to redevelopment pressures with no equivalent statutory safeguard
This is not a hypothetical risk. It is a legislative certainty.
