SAVE THE PHILLIPSBURG 4 FROM UNLAWFUL CONFINEMENT AND ADVERSE WEATHER CONDITIONS

The Issue

HELP SAVE THE PHILLIPSBURG 4 FROM BEING UNLAWFULLY CONFINED!  TAKE A MOMENT TO SIGN AND SHARE.

This is NOT the first time this owner has been charged with animal cruelty, yet the police department and the Warren County Prosecutor refused to swiftly enforce the Animal Cruelty Statute to remove the dogs from these cages -  4:22-17.4 Unlawful Confinement.  (See the actual law below)

The Police Department has been aware of the current situation for over a week now and it does nothing to take action to remove these dogs from unlawful confinment.  The County has been aware and the County HLEO does nothing but interview people.  

New Jersey has laws that protect companion animals with early intervention before they are in a medical emergency or death.  They have the ability at the sight of animal cruelty to call the municipal judge and get a Warrant over the phone right on the spot.  THEY DID NOT AND HAVE NOT!  When animals are seen in metal cages outside it is illegal confinement!  

As of right now today, June 1, 2023, at 12:48 pm it is 82 degrees, the dogs have been in a structure without proper ventilation and possibly no proper light.   IMAGINE WHAT THE TEMPERATURE IS INSIDE THAT STRUCTURE!!! This is against the animal cruelty laws also 4:22:17.  The police and the County Prosecutor's office remain actionless.  Please let them know that New Jersey expects law enforcement to uphold and enforce the animal cruelty laws in the state of NJ.

4:22-17.4. Confinement of a dog, domestic companion animal, or service animal deemed unlawful in certain circumstances; exceptions; liability 

 

     a.    It is unlawful to confine a dog, domestic companion animal, or service animal in any structure, room, area, or container that does not comply with the standards and requirements of proper shelter as set forth in section 5 of this act, except as provided in subsections b. and c. of this section. (section 5 is proper shelter)  

 

4:22-17.5. Proper shelter for a dog, domestic companion animal, or service animal; exceptions

     b.    Any part of the residence of an owner, or other person with custody or control, of a dog, domestic companion animal, or service animal shall be proper shelter for a dog, domestic companion animal, or service animal, provided that the part of the residence, and the use thereof, are in compliance with the requirements for proper shelter set forth in this section.
c.    Proper shelter for a dog, domestic companion animal, or service animal shall not include:
(1)    a crawl space under a building or a part of a building, such as under steps, a deck, or a stoop;
(2)    the space under a vehicle;
(3)    the inside of a vehicle if the dog, domestic companion animal, or service animal is kept in the vehicle in a manner or for a length of time that a person should reasonably know poses an adverse risk to the health or safety of the animal; or
(4)    any structure or protection {a) made from pressure-treated wood which contains the chemicals arsenic or chromium, {b) with a floor consisting of wire or chain-link or having openings through which the paw, hoof, or foot of a dog, domestic companion animal, or service animal, as applicable, can pass, or {c) that is located outdoors and is made from cardboard or other materials that are easily degraded by the elements.
