Last Week's Hearing

The hearing on Wednesday May 24th was primarily to decide whether or not Yaalx has standing. Yaalx is the group of investors who want to buy the Luther Hotel property at a higher offer price, and keep the hotel standing. There was much discussion of antitrust law, and Yaalx lawyer Cal Bobbitt stated that it was not appropriate for a buyer and seller to make a closed-door deal (the buyer and seller) without having the hotel for sale on the open market, while disregarding Mr. Jack Findley’s known wishes.

There was much talk about Rule 91a which means that a party to a lawsuit may move “to dismiss a cause of action on the grounds that it has no basis in law or fact." However, there was discussion as to whether or not the time period for the Estate's lawyers to dismiss the Yaalx lawsuit had already passed. Judge Spencer said she thought there was a 45-day limit whereas lawyers for the estate argued that they were uncertain of the 45-day start date. Basically, Judge Spencer said the time period was uncertain and asked the lawyers to get back to her. She wanted to take more days to look over everything, regardless.

Attorney John Griffin briefly reported on his reaction to the deposition of the executrix, expressing that it was very surprising that she did not know the contract she signed was for demolition, nor did she know that there was another offer that would save the hotel and provide the heirs with more money.  She also stated that she would prefer having the judge’s help in the decision making as long as she were kept in the loop.  This topic was not on the agenda for the hearing, but appropriate to consider as soon as possible as things move forward.
