친애하는 새크라멘토 한국학교 가족과 관계자 여러분께 

새크라멘토 한국학교의 학생, 학부모 및 교사인 우리 모두는 학교를 위기에서 구출하고자 하나됨을 선언합니다. 학교를 위기에 빠트린 긴급한 현안을 해결하고자 우리 모두는 한목소리로 이 청원서를 제출합니다.

현 이사회는 학교 재정을 고갈시켰고 학사행정을 위태롭게 하며, 의사 결정에 있어 투명하지 않을 뿐 아니라 이사회의 본분인 새크라멘토 한국학교(비영리재단)의 자산관리에도 의무를 다하지 않고 있습니다. 또한 학교 존립의 바탕인 학생과 교사의 학습 환경마저 불안정하도록 위기를 초래하였기에 우리 모두는 심각한 우려를 표명합니다. 

현 이사회를 주도하는 핵심 구성원의 활동은 새크라멘토 한국학교가 교육 기능을 유지함에 있어서조차 장애물이 되고 있습니다. 다음과 같은 근거에 입각해 핵심 구성원의 즉각적인 사퇴를 요구합니다.

 다  음  -

 가. 리더십 부재 : 

현 이사회는 학생, 학부모 및 교사의 우려를 지속적으로 묵살해 왔으며 교육에 필수인 요구 또한 수용함에 있어 태만하였다. 이로 인해 교사 및 학부모의 실망과 불만이 가중되었고, 이사회의 무능한 리더십은 교장과 교감의 연이은 사임을 초래하였다.

 - 본 학교의 정관을 준수하지 않음. 

 - 디렉터와 오피서 보험(이하 D&O)에 대한 인식 부재 및 공공 건물에 필수 요건인 보험 부재. 건물 유지가 이사회의 핵심 업무 임에도 D&O 보험 부족분을 교사 학부모 단체인 PTA가 보상하도록 함. 

- 이사회는 ‘전직 이사장 모임, 책걸상 교체비용 $5,000 기부’라고 신문에 기사화 하며 교장에게 책걸상을 구매하도록 지시했지만, 아직까지 기부금을 전달하지 않고 있음. 

 -이사회는  2023년 가을 학기 등록일 당일에 등록금 인상 계획을 발표하며 등록을 중단시키는 학사 마비 사태를 일으켰다. 등록금 인상에 대한 이사회는 한 달이 지난 시점에 열렸으며, 등록금 인상에 요구되는 학교 발전 계획과 예산 확보안 부재. 

 - 이사 자녀 등록금 전액 면제에 대한 세부 지침 부재로 학사 행정에 물의를 빚음.

 나. 부실한 재정 관리: 

이사회는 불투명한 재정관리와 독단적 집행으로 한국학교의 소중한 자산에 손실을 입혔다.

- 현 이사회로 이월된 IRS 벌금 40,000달러에 대한 실현 가능한 해결 방안 부재. 

 - 당면 요구되는 교육에 관한 지출을 외면한채 독단적인 사업 진행으로 학교 운영에 타격 초래. 예산 부족 (역대 이사장들과 이사들의 공식적인 반대에도 불구하고 동판 설치 강행)

 - 예산에 없는 강당 무대를 개조하는 큰 지출을 함에 있어 민주적 절차(전체 이사회 승인)를 거치지 않아  PTA 이사들의 사임을 초래함:http://dc.koreatimes.com/article/20220717/1424366 

 다. 교육 환경 제공 실패: 

현 이사회 출범 이후 학교 시설물의 상태가 악화되었다. 시대에 맞는 인프라 구축을 외면했고, 안전과 교실 기본 설비 투자도 거의 이루어지지 않았다.

 - 보안 부재. 특히 2023년 3월 14일 절도 사건 이후 건물 안전을 개선하겠다고 한 약속 또한 이행하지 않음. 저녁 수업 개설에 맞춰 수강생의 안전을 위해 외벽 및 주차장 조명을 요구하였으나 현재까지 방치.
- 전문적인 보안회사 의뢰 대신 재향군인회원들에게 바깥 공간 사용을 약속하며 순찰 서비스 제안. 이로인해 현 건물의 보험 적용 범위에서 재향군인회의 안전이 배제됨.

우리는 지금까지 이사회와 진심어린 소통을 하고자 열린 자세로 여러차례 최선을 다해왔습니다. 학교를 위한 건설적인 방안들을 제시하며 이사회가 포용적으로 의사 결정을 하도록 촉구하였으나 실패하였습니다. 이사회는 끝끝내 민주적인 방식으로 문제를 해결하려 하지 않았고 우리의 간곡한 요청에 응답하지 않았습니다.

우리의 주장

*임시 이사회 구성

현 이사회의 즉각적인 해체를 요구하며 차기 이사회가 민주적으로 투명하게 선출될 때까지, 새크라멘토 한국학교의 학생 학부모 교사(PTA) 모두가 인준한 5인의 대표로 임시 이사회를 구성할 것을 제안합니다.

*현 정관의 시급한 개정

이사회 내부에서 일어나는 반복적인 민주주의 파괴를 방지하기 위해 새로 선출된 이사회가 신속히 정관을 개정하기를 요청합니다. 개정 될 정관은 민주성과 재정 투명성을 보장하고 책임 있게 학교 자산을 관리하도록 구체적인 지침이 명시되어야 합니다.

* 조치 요구와 법적 대응

문제의 중대성을 고려하며, 우리는 2023년 9월 29일(금요일)까지 현 이사회의 즉각적인 해체를 요구합니다. 이에 불응한다면 2023년 9월 30일(토요일)부터 교사 파업과 전교생 등교 거부로 이어질 수 있습니다. 또한 현 이사회의 파행과 향후 일어날 분란을 해결하기 위해 법적 조치가 취해질 수 있음을 알립니다.  

우리 모두는 요구안이 즉시 이행되어야 우리의 자랑스러운 한국학교가 위기에서 벗어나, 눈부신 성장을 이뤄온 우리의 교육 내용이 지속가능할 수 있다고 믿습니다. 우리가 오늘 한목소리로 청원하는 궁극적인 목적은 새크라멘토 한국학교 공동체가 더욱 풍부한 교육을 제공하고, 교사들에게 품격 있는 환경을 조성하며, 시대에 맞춰 지속가능성을 보장하는 길로 나아가고자함입니다.

새크라멘토 한국학교 학부모교사협의회

Dear Members and Stakeholders of the Korean School of Sacramento,

We, the concerned members, parents and teachers of students attending the Korean School of Sacramento, submit this petition to address the urgent issues affecting this important institution. It is with a heavy heart that we express our deep concern regarding the gross incompetence in handling operational matters of the current board of directors, non-transparent decision-making, the overt mismanagement of the nonprofit organization's assets, and the failure to provide a suitable learning environment for students and teachers.

Demand for Resignation of Current Board Members:
We firmly believe that the continued tenure of the current board members poses a significant obstacle to the sustainability of the Korean School of Sacramento. The following are some of the key reasons for our demand for their immediate resignation:

a. Incompetent Leadership: The current board has failed to demonstrate effective leadership in addressing the concerns and needs of the students, parents, and teachers. This has resulted in the resignation of both our principal and vice principal in addition to a growing sense of frustration and disillusionment among the school community.

• Failures to adhere to established bylaws.
• Significant oversight for the Directors and Officers (D&O) insurance and lack of adequate insurance to cover other parties using the building. The Parent-Teacher Association (PTA) covered the cost of D&O insurance deficit.
• Recent commitment by the board to raise $5,000 from previous board members, with the directive to the Principal to purchase desks and chairs, was not followed through, resulting in uncollected donations.
• Lack of long-term planning and fiscal responsibility as evidenced by the decision to close registration for the fall semester of 2023 after just one hour, followed by a vote on another tuition increase a month later. This resulted in a one-month delay in the opening of registration for the fall 2023 semester.
• Operational challenges stemming from lack of transparent guidelines regarding tuition waivers for board member and PTA board member children.
   

b. Financial Mismanagement: There have been numerous instances of questionable financial decisions made by the current board, resulting in the misallocation of valuable resources and a lack of transparency in financial matters. 

• Lack of clear plan to resolve the existing $40,000 IRS fine owed by the Korean Community Center
• Unnecessary expenditures on non-critical items during time of serious budgetary shortfalls in critical areas of operation. (See the plaque installation plan despite opposition from most former board directors, community leaders, and other concerned individuals: https://baynewslab.com/?p=55797
• Undertaking the retrofitting of the school stage without obtaining full board approval, which subsequently resulted in unexpected expenditure and the resignation of PTA board members: http://dc.koreatimes.com/article/20220717/1424366

 

c. Failure to Provide a Suitable Learning Environment: The physical condition of the school facilities has deteriorated significantly under the current board's supervision, with little to no investment in infrastructure, safety, and classroom resources. 

• The absence of adequate security measures and the failure to fulfill their commitment to enhance building security following the recent robbery on March 14, 2023. This includes the provision of exterior lighting for evening classes, leaving attendees in poorly lit parking lots.
• A commitment made to a Korean veterans' group to utilize our outdoor grounds for their meetings, in exchange for their security patrol services, instead of hiring a professional security company. It's important to note that our insurance coverage does not extend to veterans in the event of injury or security incidents resulting in harm.

Despite earnest attempts to address the issues mentioned above through a democratic and transparent process, our endeavors have regrettably yielded no positive outcomes. We have consistently sought to engage all stakeholders, encouraging open dialogue, constructive feedback, and inclusive decision-making. However, it has become increasingly clear that the current board's responsiveness to these efforts has been lacking. 

Appointment of an Interim Board:
In light of the urgent need for change, we propose the immediate appointment of an interim board to oversee the affairs of the Korean School of Sacramento until a new official board of directors can be elected through a fair and transparent process. We suggest that five members of the Parent-Teacher Association (PTA) be assigned to serve on this interim board. These PTA members have a vested interest in the school's success and have demonstrated a commitment to its well-being.

Update of Current Bylaws:
To prevent a recurrence of the issues we have outlined, we also request that the newly elected board of directors takes swift action to update the organization's bylaws. These updated bylaws should reflect modern, democratic governance practices, ensure financial transparency, and establish clear guidelines for the responsible management of the school's assets.

Call for Action and Consequence:

Given the gravity of these issues, we hereby demand the immediate disbandment of the current board of directors by Friday, September 29, 2023. Failure to comply with this demand through a written response will result in a collective walkout by our dedicated teachers and the withdrawal of our students by concerned parents starting Saturday, September 30, 2023, and may also lead to potential legal action as a means to address the ongoing problems and concerns within our institution.

We believe that the immediate implementation of these steps is essential to the restoration of trust, accountability, and the continued success of the Korean School of Sacramento. Our ultimate goal is to provide the best possible educational experience for our students, promote a nurturing environment for our teachers, and ensure the long-term sustainability of our beloved institution.
