We have grave concerns that new tattoo ink regulations in Queensland have the potential to seriously limit access to quality tattoo inks for professional tattoo artists.

The QLD State Government have recently held a Parliamentary Inquiry into proposed amendments to the Medicines and Poisons Act 2019 which would create compliance measures for a departmental draft ink standard. These amendments make it an offence for Australian suppliers to sell ink in Queensland without a Certificate of Analysis from the manufacturer. There is also an amendment in this legislation that makes it an offence for tattoo artists within the state to be reasonably satisfied that the Certificate of Analysis exists, and can prove this. Due to irregularities in testing regimes within the European Union and the USA - where the majority of tattoo inks being used by professional tattooists in Australia originate - the Certificates of Analysis are occasionally out of date or unobtainable by the supplier.

The Australian ink market is small in comparison to the wider global market and genuine concerns are held that if our governments apply unreasonable and unachievable limits on manufacturers, they will simply discontinue selling to the Australian market - placing Australian professional tattoo artists in the position of having severely restricted ink supplies, if any at all.

Industry bodies, the Professional Tattooing Association of Australia (PTAA) and the Australian Tattooists Guild recently gave input at the public hearing and provided submissions to inform the Queensland Government about this issue. The response from the Inquiry essentially ignored the very real and relevant problem of limiting the most basic and important supply for tattoo businesses across the state - tattoo ink.

The PTAA and the ATG, on behalf of our broad membership, request that the QLD Parliament re-examine the requirement for Certificates of Analysis being used as a bench mark for compliance within the Medicines and Poisons Act 2019 (48A) amendments.

Furthermore we submit that the current public consultation into the development of an ink standard being developed by the QLD State Health Department be put through extensive and exhaustive consultation prior to being finalised.

We call on the good people of Australia to stand with us in requesting the Queensland Government make changes to this legislation which has the potential to fundamentally damage the tattoo industry both within the state and across the country, damage thousands of small business owners and contractors, and destroy the vibrant sub culture within which they exist.
