"Dear Council Members,
The application for 910 S Mariposa does not meet the SB35 qualification in which 75 percent of the perimeter of the site adjoins parcels that are developed with urban uses 65913.4. (2) (B)
Under SB35 65913.4 (10)(h)(8) “Urban uses” means any current or former residential, commercial, public institutional, transit or transportation passenger facility, or retail use, or any combination of those uses.
(5) ...Standards may be embodied in alternative objective land use specifications adopted by a city or county, and may include, but are not limited to, housing overlay zones, specific plans, inclusionary zoning ordinances, and density bonus ordinances...
The parcel East of 910 S Mariposa is zoned OS-1XL-RIO which is designated Open Space by the city of Los Angeles.
The parcels to the North and South are zoned M-1 and designated Limited Industrial by the city of Burbank. Burbank's General Plan adopted February 19, 2013 has a zoning map that was last amended by Ordinance No. 3802 Effective 2019 showing these properties zoned as M-1 Limited Industrial. These properties are not applying for SB35 to qualify under different zoning. Therefore they fall under the zoning ordinance designation of Industrial.
While the need for affordable housing is great, this site is not the best location as it destroys the safety of the community trying to enjoy the open space.
Open Space, and Industrial zoning does not qualify under SB35 guidelines and definitions. I ask that you please look into these facts and deny the application for 910 S Mariposa."
