The Issue
Background: The FAA gives the power to regulate flight schedules to the local airport authorities. FAA regulations on airplane noise contain this statement (bolding added for emphasis): “Other powers and authorities to control aircraft noise rest with the airport proprietor – including the power to select an airport site, acquire land, assure compatible land use, and control airport design, scheduling and operations – subject to constitutional prohibitions against the creation of an undue burden on interstate and foreign commerce, and unreasonable, arbitrary, and unjust discriminatory rules that advance the local interest, other statutory requirements, and interference with exclusive federal regulatory responsibilities over safety and airspace management.”

Residents have already experienced sleep disruptions from the late night and early morning flights. If there is an expansion of commercial flights – such as for an Amazon warehouse – flights could be around the clock.
We, the undersigned residents of New Haven and East Haven, petition our representatives to protect our quality of life, our health, and our sleep by adding a provision to the 43-year lease between the Tweed Airport Authority and the City of New Haven as follows:
- Flights to and from Tweed Airport shall be restricted to the hours of 7 AM and 10 PM seven days a week.
- Any attempt to circumvent this restriction shall be deemed a violation of the lease agreement.
- Any flight in violation of this provision shall incur a penalty of $5,000 per flight.
- Funds generated shall be used to mitigate air and noise pollution generated by airport operations.
