Technical Difficulties Will Put Plat and Site Plan back on City of Dania Beach Agenda

In a prime-time movie like twist (we couldn't script this stuff) while debatable, the law related to decisions in quasi-judicial hearings suggests that the action taken by the City of Dania Beach on August 25th does not equate to a denial of the developer's plans. 

At the conclusion of presentations by the Warehouse developer versus those representing the Mangroves, Vice Mayor Marco Salvino made a motion to approve the developer's warehouse.  The place went silent.  There was no second to his motion.  The Fantastic Four (Davis, Lewellen, Ryan and Rimoli) refused to second the motion.  The motion failed.  Some would argue if the motion failed then the applications were denied.  But, not so fast.  The technical glitch suggests that in order for the applications to be denied, the City Commission would have to actually take a vote to deny.  

The law states:  "For applications that require final action through a quasi-judicial hearing or a public hearing, the municipality must approve, approve with conditions, or deny the application...".

So, the City of Dania Beach will now need to discuss this matter and determine how and when the applications will be put back on the agenda.  No matter, the facts are the facts.  We contend the applications must be denied despite the developer's threats of litigation if he doesn't get what he wants.  Remember, the landowner has the right to apply for plat and site plan approval; but he does not have the right to get them.  We contend that these applications should be denied based on competent substantial evidence that approval violates City, County, State and Federal laws.  We see no reason the action by the Fantastic Four will be different no matter how many times the developer tries to get what he wants.  We believe the Fantastic Four will "stay the course" and vote to deny the developer's application to place a monster warehouse in the mangroves.

What can you do to help?

1.  Contact the Fantastic Four to thank them for their actions to save the Mangroves and ask them to "stay the course."

2.  Contact the Broward County Commission and ask them to please come up with a solution to save these mangroves in perpetuity (suggest purchase, land swap, eminent domain, mitigation bank, donation from developer, whatever it takes!)

Together, united, we can save these mangroves.  Please make your voice heard!!  When a warehouse goes up on these mangroves, it won't be because we didn't stand up and speak loudly and clearly.  This outrageous result will be on them!
