Dear friends and neighbors,
On March 5, 2021 we filed a request to become substitute appellants in an appeal of a variance approved in July of 2020 to Style Works Design Build, LLC 2020-0024-V (AD3, CD5) to allow a dwelling with less setbacks than required and with disturbance to slopes 15% or greater (steep slopes) on property known as lot 390 off Old County Rd (Mt. Misery). The original appellant, Shane Sanders, had to relocate for employment due to Covid-19. We reside beside and adjacent to the proposed property and have been involved with the case from the beginning as concerned parties.
In response to the developers motion to dismiss, we noted to the Board that if it were not due to Covid-19, the original appeal filed by Mr. Sanders would have likely already been heard before he had to move out of state for employment. The appeal was proper when filed in August of 2020 and nothing about this substitution or request to intervene will deprive the board of its jurisdiction. Thus, there is no jurisdictional defect.
Additionally, we attended all prior hearings held on the property - June 16, 2020, and January 28, 2021 - and are proper parties to begin with based on our involvement with the case and our proximity to the proposed development. This is simply a technical request, nothing substantive will change, the evidence will be the same, the burden on the developer will be the same, and allowing the substitution will not prejudice the developer.
We have asked the Board to allow this request to intervene so that the appeal can continue. We hope that due process for all parties involved can bring a conclusion to this matter.
The county has since scheduled a hearing on August 25th to hear arguments related to the motion to dismiss only. You are welcome to attend and show your support. However, if you are unable to attend but are in favor of the substitution of Suzanne Mead and Danielle and Scott Dupcak as appellants to the Appeal filed in August of 2020, we ask that you digitally sign the petition below.
