Dear Friends of the Press:

Your reputed newspapers, television channels and news agency feeds have reported the court judgment order in the case of PIL 88 of 2018 (Please refer http://tiny.cc/ghy4cz Below is the statement we make about this judgment so that you all see our side of the story for representation in your reputed newspapers and channels.

 

Statement:

First of all, we respect and honour the judicial institutions of this country.

Secondly, Abhivyakti is an organization comprising common members of the society who have come forward to take up social causes for the betterment of the civic, environment and social situation of Kharghar and its surroundings. We are not full-time activists – but just good intentioned citizens doing our duty to nation and society.

With respect to the judgement pronounced on PIL 88 of 2018, dismissing it and penalizing us a fine of Rs. 1 lakh, we are highly dejected by it. We believe the matter has not got the deserving serious consideration from the court bench that passed this judgment. Our simple petition was to save a large pond from being reclaimed by authorities against the wishes of residents. And to plead on behalf of the residents who want to preserve it and fear the ill impacts of reclamation – including water logging, pollution and climate change.    

It looks like the respondents have managed to convince the court by skillfully manipulating things in front of court and by misguiding them about our petition, including taking our statements out of context several times and placing incorrect information before the court. They also misled the court by putting forward statements based on in-factual coordinates that are unrelated to our pond. Their intention clearly has been to advance more commercialization and concretization throughout the city, caring the least about the welfare of residents, the environment and needlessly destroying nature. CIDCO and the State government authority has completely failed to maintain the city - poor condition of road, water scarcity and destruction of all water bodies are live examples of their negligence. Instead of working for the public, CIDCO the town planning body acts like a private company wanting only to make money. This they do by wasting huge amount of public money on litigations to fight the genuine public interest cases put up by organizations such as ours.

It is also unfortunate that this court has not reflected upon why members of our group sacrificed for this PIL their professional and personal time and spent significant amount of time and resources on this case – with zero financial contribution from anybody else. Instead of rewarding us for setting good examples of citizens carrying out their constitutional duties, we have been instead penalized for taking this case to the court. We please that this will send the wrong signal to anybody who wants to go to court to defend the nature and environment which are the citizens’ fundamental rights.

Ultimately, we are left with no options other than to plead further with the Court(s) and to take further legal recourses as needed, which we will be doing so in the near future.
