I am extremely thankful for your overwhelming support in this stressful time. The positive feedback and heartfelt stories help me to remember why I'm in this business, in this community.
Since the initiation of the petition we have had several communications and meetings with the City of Toronto trying to find a solution to this ongoing battle of licensing for our patio. My position is this- the current patio configuration was approved in 2016.
It is beyond my understanding as to why there is an issue now? Normally I pay my fees, I get my permits and the season carries on.
The City has informed me that the outdoor lights are an issue as well as the posts supporting them. When I requested official notice of the violations I was told to go to the "Freedom of Information Act"- this is vague at best and wholly unhelpful.
The City is demanding an application for a NEW patio ( I have been here for 20 YEARS!!!!).
Any administration process with the city is not an easy one. My experience with past applications and hearing from other restaurateurs current applications are being caught up in red tape. I can't afford to lose a patio season. Spring and summer is when I make up for those dead/cold, fall/ winter days.
After speaking with a representative from a well known café in the Annex, I learned that council approved a motion to allow their patio to operate through the present season. This would give them time to address any issues and maintain their earning potential. I have asked for the same allowance but our counselor would not put forth the motion, How is this fair?
However, council DID waive the 30 day residential polling period for my patio and the presence of a 7' tall fence at the back of the property. These exceptions do not guarantee an immediate expedition of my application. Residential polling only applies to new patios. It was agreed (years ago) the fence would not be put in place for safety concerns of the immediate residence. Again, I have been here for 20 years! I have always been respectful of my neighbours.
Hiring full staff is impossible in this situation- what certainty can I offer them? Bookings for future weddings and celebrations is at a standstill. This threatens the livelihood of myself and my staff..
Since 2022 I have requested official written documentation of the violations, only to be given a verbal order..... told to go to The Freedom of Information Act. This makes no sense! If you violate the rules of the road your ticket clearly states the violation and the fine you need to pay. Why is this different?
My business license is in jeopardy due to ghost violations, that no one wants to put a stamp on.
I believe this is a personal attack on me, Desotos and small business in general.
Since these "issues" have surfaced Metro Licensing and Standards have given me a consistent run around. I hope to have this resolved and continue to be operating on St. Clair.
