Save a life... 3 hp scooters/mopeds are NOT Motorcycles

The Issue

Scooters/mopeds are  great energy savers and a alternative to gas guzzling automobiles. The popularity and number of scooter/mopeds is increasing,  and is expected to keep increasing.

As of Jan 1, In Nevada,  50cc Scooters/mopeds require registration.

The problem is in  the classification of these scooters/mopeds.  According to Dept of Motor Vehicles and the NRS 482.069    .. A  50cc 2 horsepower scooter/moped  is classified as a scooter/moped.  The 50cc 3 horsepower scooter/moped, however  is being classified as a "Motorcycle" and along with that classification comes  the requirements  and  privileges of a Motorcycle. With this motorcycle classification comes the legal right to acess all streets and highways including the freeway.  This is where I forsee disaster.

These scooter/mopeds are designed with a top speed of 30 mph.

The power difference between the 2 hp and the 3 hp Scooter/moped is negligible.  A 3hp scooters/moped does not have the power nor the maneuverability that a "Motorcycle" has. Should never be driven on the freeway. Therefore  I am asking you to join me in this petition to have the   NRS 482.069 revised to included the 3hp scooter/moped.

 Public safety is a State priority.and left unchanged this has the potential to be disastrous, possibly even Fatal.

 

Please help me change the Nevada revised  statute  to include the 50cc 3 hp scooter/moped as a Moped in accordance with NRS 482.069

 

NRS 482.069 - “Moped” defined.

“Moped” means a motor-driven scooter, motor-driven cycle or similar vehicle that is propelled by a small engine which produces not more than 2 gross brake horsepower, has a displacement of not more than 50 cubic centimeters or produces not more than 1500 watts final output, and:

1. Is designed to travel on not more than three wheels in contact with the ground but is not a tractor; and

2. Is capable of a maximum speed of not more than 30 miles per hour on a flat surface with not more than 1 percent grade in any direction when the motor is engaged.
