Call to Action: San Gabriel Pomona Regional Center (SGPRC), Regional Center Board of Directors
Dear Supporters of Justice,
The San/Gabriel Pomona Regional Center’s (SGPRC) Board of Directors are operating illegally in violation of the law.
1.) According to the bylaws, SGPRC is required to have 9 (nine) Board Members to make decisions. The Board has approved millions of dollars of illegal contracts intentionally and with knowledge of doing so, and has taken Board action with only 7 (seven) Board Members, making all of those decisions null and void according to the law. According to the bylaws Section 3.02 The Board shall consist of nine (9) to fifteen (15) Directors.
2.) Applicants of Color were intentionally denied access to serve on the Board, also in violation of their bylaws, as well as discriminatory in nature. This denial of access disallows voices of diverse representatives. Section 3.03 (d) The Board shall reflect the geographic and ethnic characteristics of the area served by the Corporation. During 2021 & 2022 at least 5 applicants of Hispanic, Asian, and African American ethnicities, were denied a seat on the full Board of Directors, when the Board needed Directors to comply with its Bylaws. The Board’s action violates the Lanterman Act, is wrong and is a discriminatory practice and policy that is shameful and harmful to communities of color violating public trust, its contract with DDS and the 14th Amendment denying people of color equal treatment under the law (Lanterman Act). The DDS contract with SGPRC’s Board requires immediate cancellation. DDS should not be allowed to contract with a board that discriminates against people of color.
3.) The SGPRC Board of Directors intentionally concealed their unlawful activity and violations from the Department of Developmental Services (DDS) to avoid removal of its contract. According to Section 4635(a) of WIC (Welfare and Institutions Code) (Lanterman Act) 4635. (a) If any regional center finds that it is unable to comply with the requirements of this division or its contract with the state, the regional center shall be responsible for informing the department immediately that it does not expect to fulfill its contractual obligations. Failure to provide the notification to the department in a timely manner shall constitute grounds for possible revocation or non-renewal of the contract.
4.) The SGPRC Board of Directors are approving unlawful contracts, which is a breach of their fiduciary duty to the community. We need an IMMEDIATE suspension of the contract between DDS and SGPRC Board of Directors to prevent further violations of the law. We need to STOP the SGPRC Board of Directors from causing further irreparable harm to the community. We are also requesting an IMMEDIATE investigation to be conducted regarding the SGPRC Board of Directors illegal activity, by DDS and The State of California Attorney General's Office and removal of the contract between DDS and the SGPRC Board of Directors.
