End the expansion of Newby Island Landfill in Milpitas

On December 7, 2016 the Planning Commission of San Jose voted in favor of allowing the Newby Island Landfill to expand. Due to this consent, Santa Clara County can expand up to 15.12 million cubic yards and extend its closure date to January 2041. The maximum height of the landfill is expected to reach 245 feet high. 

Residents of Milpitas, California have reported that an odor is wafting throughout the city due to the size of the landfill. The expansion of this landfill will cause these awful odors to reach San Jose and Fremont. It is said that the smell is already reaching into some areas of Downtown San Jose and the San Jose International airport. This public nuisance needs to end due to the many complaints that have been made by this community. 

Statistics on odor complaints. Through the years 2005-2008, there have been 3 confirmed complaints and 155 unconfirmed. Upon the most recent year the Milpitas city odor website has received over 450 complaints. The Bay Area Air Quality Management District has received over 2300+ complaints since 2013. These complaints clearly demonstrate the significant impact it has upon residents, creating a public nuisance.

Violations. Since 2010 there has been a total of 17 notices of violation. BAAQMD: 10 total notices of violation. Regulations: 1-301, 1-30x, 8-34-30x. Cal Recycle: 2 total notices of violation. Regulations: 21600, 20510. San Jose LEA: 5 notices of violation. Regulations: 20921.

Environmental Impact. The Newby Landfill had a new ground water test in 2015 that displayed a 1.4 dioxide (carcinogen) contamination. 

Residents in the communities affected have attempted to end this situation, but have failed because of the lack of representation. If we want to make a change we must stand together. By signing this petition our signatures will demonstrate the impact of this problem. Our voices must be heard. A change will only be made if residents stick together. We live in the Silicon Valley, the heart of high technology...don't let a stink like this affect the beauty of this community!
