Our Ask: The good, kind neighbors of Eastern Way have had enough of the bullying, harassment and strategic vehicle manipulation by the residents of 74 Eastern Way. We ask for fair, reasonable accommodation of on street parking for the handicapped resident of 76 Eastern Way. We ask the Rutherford Boro Council to grant handicap parking tag 2361185 (Fiqirete Asllani) a personal designated spot in front of 76 Eastern Way for the purposes of reasonable accommodation that is currently NOT being met with a generic handicap parking spot in front of 76 Eastern Way due to the bad actions by the residents of 74 Eastern Way. This request is supported by the signatures of the good people of Eastern Way who recognize this injustice and respectfully ask the Council's support to remediate this ongoing and escalating issue. 

The Problem: The residents of 74 Eastern Way strategically manipulate three out of their four vehicles with on street parking, purposefully monopolizing valuable on street parking real-estate as a means to harass, bully, intimidate and otherwise annoy their fellow residents of Eastern Way. Their on street parking manipulation, despite having a lengthy driveway, creates on street parking issues not just for the handicapped resident of 76 Eastern Way, which does not have a driveway, but the entire street without ample parking due to their intentionally disrespectful behavior. 

Since May 2021, the residents of 74 Eastern Way are, as retribution against 76 Eastern Way, parking a handicap tagged vehicle (2368634) not in their own driveway (where one ought to think handicap usage would be most accessible), but in the handicap spot created for the purposeful use by, and at the explicit request to the Rutherford Parking Authority of, handicap parking tag 2361185 (Fiqirete Asllani). The on street vehicle owned by 74 Eastern Way does not move from the generic handicapped spot requested for parking tag 2361185 (Fiqirete Asllani) in front of 76 Eastern Way with the exception of the few hours each week during street cleaning, in clear violation of Rutherford Council Code § 125-2 "Abandoned Vehicles which have been continuously parked in any public street or or any public land for a period of five days." 

The Solution: The actions of the residents of 74 Eastern Way negates the well-intended and reasonable accommodations made by the Rutherford Parking Authority to create a generic handicapped parking space in front of 76 Eastern Way for use by handicap tag 2361185. By most accounts, the majority of reasonable individuals would NOT park in a handicapped parking spot they did not personally request. However, it is within the respected Rutherford Council's power to grant a personalized parking space for handicap tag 2361185 to right the injustice these unusual and unreasonable circumstances have created, sadly at the hands of one bad-acting household, 74 Eastern Way. While this request is unusual, it is not without precedent as stated by the Rutherford Parking Authority and the Honorable Council President Mark Goldsack. 

Call to Action: Support all the good neighbors of Eastern Way by designating a personal handicap parking spot to tag 2361185 (Fiqirete Asllani) in front of 76 Eastern Way. This solution will overall reduce Eastern Way on street parking issues and provide Fiqirete Asllani with the safe, fair and reasonable handicap parking accommodation she deserves without fear of harassment or intimidation. 

The signatures of this petition support the proposed solution to designate a personal handicap parking spot for handicap tag 2361185 (Fiqirete Asllani) and respectfully ask the Rutherford Boro Council to grant this fair and reasonable request without further delay.
