In data 31.01.2023, per decisione del Municipio di Monteceneri, è stata imposta la chiusura de IL PARADISO DEI CANI, che con l'arrivo della polizia, è stato costretto a chiudere solo perché non rispettava il piano regolatore. Si, perché’ una pensione per cani, anche se ve ne sono diverse in queste zone, non è permessa in zona agricola (solo destinata ad animali da reddito), non nella zona residenziale (solo per abitanti), non nella zona “fuori zona” perché’ destinata solo a vacanza per umani, quindi restano zona industriale e artigianale. Il Paradiso dei Cani è collocato in un "fuori zona" dove non si può svolgere nulla, se non vacanza per umani, secondo il regolamento, anche se sarebbe la zona ideale per i cani. Sono oramai almeno la terza attività che chiude per lo stesso motivo in Ticino. È il solo motivo per cui abbiamo chiuso perché le altre argomentazioni presentate dai nostri oppositori erano nient'altro che calunnie e falsità supportate dal nulla, se non da cattiveria ed invidia e forse ostilità verso i cani. In cinque anni, non abbiamo arrecato disturbo ad alcuno e vi sono cinque dichiarazioni scritte ad attestarlo. 

L'attività è nata e si è sviluppata da sola, forse spinta dal profondo amore che nutriamo da sempre per i cani.  Da noi i cani erano felici, sempre supervisionati da personale professionale, erano in vacanza ed erano sereni, come anche i tanti nostri clienti e proprietari di cani. Non c'era alcun rumore molesto, poiché' i cani erano chiusi la sera e di giorno, il livello di rumore era massimo livello 2 di giorno, quando passava qualcuno; quindi, raramente visto che ci siamo solo noi in quella posizione.  Non mi è stato neppure permesso di eseguire la rilevazione fonica, richiesta dall’ufficio cantonale, forse perché' avrebbe confermato che non c'era tutto quel rumore? Basti pensare che una persona che abita da 14 anni ad una ventina di chilometri di distanza e ha presentato opposizione menzionando il rumore molesto dei cani ospiti, come facesse a sentirlo ancora non me lo so spiegare…Non ci sono state proposte alternative, solo brutalità con l'unico fine di distruggere un’attività di grande utilità e molto richiesta, che aveva anche dipendenti, la cui decisione di imporre la chiusura ha presentato anche il rischio di mandarla in fallimento. Da tutto questo e' chiaramente emerso un problema molto più grande: nel piano regolatore non è contemplata un'area veramente adeguata dove poter svolgere l'attività di pensione per cani. Quindi un qualunque segnalatore ha sempre la meglio e ti fa chiudere. Sono già la terza attività che chiude per questo stesso motivo. Secondo la regolamentazione, infatti, mentre per tutti gli animali ci sono prati meravigliosi, boschi e montagne, per il cane, tra l'altro il migliore amico dell'uomo, ci sarebbero SOLO la brutta zona industriale ed artigianale. Quindi capannoni, cemento, camion e rumori di ogni sorta. Oggi i cani sono parte della famiglia, io ho due cani e vivono in casa con me, vengono in vacanza con me, non potrei e non li manderei MAI in una zona industriale o artigianale perché so che non sarebbero felici lì!

Il Canton Ticino, come altri Cantoni, ha una popolazione canina significativa, basti pensare che secondo l'Ufficio federale di statistica, ci sono oltre 500.000 cani in Svizzera e molti di loro si trovano nelle nostre comunità. La situazione e' in grave emergenza per la mancanza di strutture professionali e riconosciute. I clienti devono appoggiarsi ad improvvisati o andare all'estero. I cani sono delle creature meravigliose, che utilizziamo per Pet Therapy, per i ciechi, per la guardia, per la ricerca di dispersi, per segnalare presenza di malattie e tanto altro, meritano spazi adeguati che permetta loro di essere accuditi e stare nella natura, come qualunque altro animale, in ambienti accoglienti, in gruppo e non essere obbligati a restare in zone brutte ed industriali, magari pure in gabbia. Preciso che non ho nulla contro le strutture con gabbie, ritengo pero’ che un proprietario debba avere la possibilità di scegliere opzione che preferisce per il proprio cane. Io ho due cani che arrivano da rescue, la gabbia l'hanno già vista preferisco una realtà diversa per loro.

IL PARADISO DEI CANI e' stato trattato come una sorta di organizzazione illegale ma vorrei segnalare che vi sono, oltre 70 operatori, solo sul territorio Ticinese, non regolari che tutti tollerano e che non sono assolutamente in linea con alcuna normativa da nessun punto di vista (previdenziale, fiscale, veterinario e tanto ancora). Se deve chiudere IL PARADISO DEI CANI, dovrebbero chiudere tutti. Non si capisce per quale motivo abbia dovuto chiudere solo IL PARADISO DEI CANI, nei confronti dei quali vi è stato un accanimento fuori da ogni misura, mentre tutti gli altri, alcuni dei quali non hanno mai pagato, né AVS né altre imposte, irregolari sotto tutti i punti di vista ma tuttora esistenti e funzionanti indisturbati. IL PARADISO DEI CANI era un'attività regolare: iscritta a registro di commercio, con partita IVA, iscritta all'AVS, con dipendenti (che per questa decisione sono stati licenziati e sono tuttora disoccupati) che era stata visitata sia dalla Forestale Cantonale, che Veterinari per visionarne la struttura e valutare eventuali adattamenti e verifiche. Sopralluoghi che rappresentano una garanzia per tutti, anche per i detentori di cani. Sopralluoghi che presso operatori irregolari non avvengono mai. 

Ci terrei anche a segnalare che i proprietari di cani pagano ogni anno 100chf per il proprio cane, sembra un piccolo importo ma in Ticino ci sono 34.172 cani ciò significa che la casse dei comuni ricevono 3.417.200chf dai detentori dei cani. Ci si aspetta che per lo meno, oltre a dei sacchetti di plastica, si provveda a tenere conto anche di questa categoria e delle loro esigenze. Che cosa si intende fare per loro?

Un hotel/pensione per cani è anch'essa un’attività economica, come tutte le altre, che soprattutto alle giovani leve interessa molto e se applichiamo la costituzione sia cantonale che federale andrebbe supportata in un quadro favorevole e non distrutta con brutalità e neppure un incontro o tavolo di negoziazione. Per svolgere questa attività è necessaria una formazione per ottenere un attestato (2.000chf), sono necessari investimenti per creare alloggi adeguati secondo OPAN ma poi non si può operare regolarmente se non si è in un'area industriale ed artigianale che ha costi proibitivi (terreni di milioni di franchi e capannoni senza terreno esterno) ecc. Come si fa ad investire o affittare una struttura industriale per un'attività di questo genere? Vuol dire mandare l'impresa dritto al fallimento perché il ritorno sull'investimento non c’è. La nostra Costituzione prevede un supporto alle attività economiche, finalizzato a cercare di offrire un quadro favorevole e prevede anche l'uguaglianza di trattamento, cosa che non è stato rispettato, visto che oltre 70 operatori non rispettano il piano regolatore ma nessuno li fa chiudere.

Chiediamo quindi, considerando l’attuale emergenza per mancanza di strutture professionali in Ticino e per la chiusura iniqua ed ingiusta imposta, essendoci oltre 70 operatori irregolari, anche sul territorio del municipio di Monteceneri, la riapertura immediata dell'hotel IL PARADISO DEI CANI. Nel frattempo, chiediamo una modifica urgente del piano regolatore che tenga conto del ruolo del cane oggi nella famiglia e nella società e quindi preveda aree in natura adeguate alle pensioni per cani. La Svizzera è l’unico Stato tra i confinanti e non che prevede zone solo industriali per i cani, è una regolamentazione obsoleta e non in linea con la realtà attuale. Questo non solo garantirà che strutture come IL PARADISO DEI CANI possano operare senza problemi, ma contribuirà anche a migliorare la qualità della vita dei nostri amici a quattro zampe e dei tanti detentori di cani che in questo momento non sanno a che santo rivolgersi!

On 31.01.2023, by decision of the Municipality of Monteceneri, the closure of IL PARADISO DEI CANI was imposed, with the arrival of the police, the dog hotel was forced to close only because it did not comply with the master plan. Yes, because a dog hotel, even if there are several in these areas, is not allowed in the agricultural area (only intended for livestock), not in the residential area (only for inhabitants), not in the "outside zone" area because it is intended only for holidays for humans, so dogs remain with industrial and artisanal areas. IL PARADISO DEI CANI is in an "outside the area" where nothing can be done, except for holidays for humans. We are now at least the third business to close for the same reason in Ticino. That is the only reason why PARADISO DEI CANI closed because the other arguments presented by our opponents were nothing more than slander and falsehoods supported by nothing, if not malice and envy and perhaps hostility towards dogs. In five years, we have not disturbed anyone, and there are five written declarations to prove it, besides no claim of any kind.

The business was born and developed on its own, perhaps driven by the deep love we have for dogs.  Dogs were happy, always supervised by professional staff, they were on vacation, and they were serene, as were their owners. There was no annoying noise, since the dogs were closed in the evening and during the day, the noise level was maximum 2, when someone passed by. Due to the position, nobody would pass by as there is only us in this location.  I wasn't even allowed to perform the noise detection, requested by the cantonal office, perhaps because it would have confirmed that there wasn't all that noise? If we consider that a person, who has lived for 14 years at about twenty kilometres away, has filed an opposition mentioning the annoying noise of the guest dogs, how could dogs be heard at that distance I still can't understand...There were no alternative proposals, only brutality with the sole aim of destroying a very useful and highly sought-after service, which also had employees. The decision to impose closure also put us at risk of bankruptcy. From all this, a much bigger problem has clearly emerged: in the master plan there is no real adequate area where the activity of boarding for dogs can be carried out. So, any whistleblower who has some support, always has the upper hand, and shuts you down. This is already the third business to close for this same reason. According to the regulations, in fact, while for all animals are in title to wonderful meadows, woods and mountains, dogs, among other things man's best friend, can ONLY access the ugly industrial and artisanal area. So, warehouses, concrete, trucks and noise of all kinds. Nowadays dogs are part of our families, I have two dogs and they live in the house with me, they come on holiday with me, I could not and would NEVER send them to an industrial or artisanal area because I know they would not be happy there. The Canton of Ticino, like other cantons, has a significant dog population, according to the Federal Statistical Office, there are over 500,000 dogs in Switzerland and many of them are found in our communities. The situation is in serious emergency due to the lack of professional and recognized structures. Clients have to lean on improvised or go abroad.

Dogs are wonderful creatures, which we use for Pet Therapy, for the blind, for guarding, in the search for missing persons, to report the presence of diseases and much more, they deserve adequate spaces that allow them to be cared for and stay in nature, like any other animal, in welcoming environments, in groups and not be forced to stay in ugly and industrial areas,  maybe even in a cage.  I have nothing against structure with cages, I believe thought that an owner has to have the option to choose. I have two dogs that come from rescue, they have already seen the cage and will NEVER see it again.

Moreover, IL PARADISO DEI CANI has been treated as a sort of criminal organization, but I would like to point out that there are more than 70 operators, only in the Ticino area, not regular that are tolerated in total silence and that they are not in line with any kind of legislation from any point of view (social security, tax, veterinary and much more). If DOG PARADISE closed, they would all have to close.

It is not clear why IL PARADISO DEI CANI is the only who had to close, against whom there was an unmeasured attack, while all the others, some of whom have never paid, neither AVS nor other taxes, irregular from all points of view but still existing and functioning undisturbed. IL PARADISO DEI CANI was a regular business: registered in the commercial register, with a VAT number, registered with the AVS, with employees (who were dismissed for this decision and are still unemployed). The hotel was visited by both the Cantonal Forestry and Veterinarians to view the structure and evaluate any adaptations and checks. Inspections that are also a guarantee for dog owners and inspections that never take place with irregular operators.

In addition, I would like to point out that dog owners pay 100chf per year for their dog, it seems like a small amount but in Ticino there are 34,172 dogs, which means that the coffers of the municipalities receive 3,417,200chf from dog owners. It is expected that at the very least, in addition to plastic bags, this category and their needs should also be taken into account.

Finally, it is also an economic activity, which especially youngsters are very interested in, and if we apply both the cantonal and federal constitutions, it should be supported in a favourable framework and not destroyed with brutality and no negotiating table. To carry out this activity you need training to obtain a certificate (2,000chf), investments are needed to create adequate housing according to OPAN (several 10.000chf) but then you cannot operate regularly if you are not in an industrial area and craft area that has prohibitive costs (land costs millions of francs and there are warehouses without outdoor land), etc. How can you invest or rent an industrial facility for an activity of this kind where revenues are not billions? It means sending the company straight to bankruptcy because there is no return on investment. Our Constitution invites local authorities to support economic activities, with the aim of trying to offer a favourable framework and also provides for equal treatment, which has not been respected, given that more than 70 operators do not comply with the zoning plan but no one closes them down.

We therefore ask considering the great EMERGENCY in Ticino of professional structure and the unfair and unjust closure, if we consider the over 70 irregular operators across the Canton and the Municipality too, the immediate reopening of the hotel IL PARADISO DEI CANI. In the meantime, we request an URGENT modification of the regulatory plan that takes into account the role of the dog today in the family and in society and therefore provides areas in nature suitable for boarding houses for dogs. Switzerland is the only European country that has only industrial zones for dogs, it is an obsolescent regulation and solutions need to be found urgently.  Switzerland is the only country among its neighbours and others that provides only industrial zones for dogs, it is an obsolete regulation and not in line with the current reality. This will not only ensure that facilities like PARADISO DEI CANI can operate smoothly, but it will also help to improve the quality of life of our four-legged friends and the many dog owners who do not know where to turn at this time!
